Procedura Lamfalussy este un demers pe patru nivele:
Nivelul 1: Comisia adoptă o propunere de directivă sau reglementare conținând principiile ce definesc cadrul de desfășurare. Odată ce acestea sunt adoptate de parlament și de consiliu, măsurile detaliate de implementare sunt dezvoltate pe nivelul 2.
Nivelul 2: După consultările cu Comitetul European pentru Asigurări și Pensii Ocupaționale - EIOPC, comisia va solicita avizul unei comisii/comitet de nivel 3 – CEIOPS (Committee of European Insurance and Occupational Pensions Supervisors). CEIOPS elaborează avizul în colaborare cu participanți din piață, de exemplu GC si CEA. Pe baza acestui aviz, comisia elaborează o propunere formală pe care o supune aprobării EIOPC, care trebuie sa se pronunțe prin vot într-un interval de trei luni.
Nivelul 3: CEIOPS elaborează recomandări de interpretare și îndrumări consistente și standarde comune (de ex. standarde IAIS sau IAA). CEIOPS va compara practica de reglementare pentru a asigura implementarea și aplicarea consistentă.
Nivelul 4: Comisia verifică în ce măsura statele membre se aliniază legislației UE și ia măsurile legale necesare.
| Translation - Romanian In 2001, the European Council approved the so-called Lamfalussy procedure for the regulation and supervision of the bond market.
The Lamfalussy procedure is a four-level process:
Level 1: The Commission adopts a directive or regulation proposal, comprising the principles that define the framework. Once these principles are adopted by the Parliament and the Council, detailed implementation measures are developed at level 2.
Level 2: After consulting the European Insurance and Occupational Pensions Committee – EIOPC, the Commission will seek the opinion of a third level commission/committee – CEIOPS (Committee of European Insurance and Occupational Pensions Supervisors). CEIOPS issues the opinion in collaboration with market participants, such as CG and CEA. Based on this opinion, the Commission issues a formal proposal, which is then submitted for approval by the EIOPC, which must reach a decision by vote within three months.
Level 3: CEIOPS issues interpretation recommendations and consistent guidance and common standards (e.g. IAIS or IAA standards). CEIOPS will compare regulatory practices in order to ensure consistent implementation and enforcement.
Level 4: The Commission checks to what extent member states are aligning with EU legislation, and takes required legal action.
