Dear Sir,
Further to our meeting yesterday and after analysis of the Court of Appeal decision dated 8 June 2009, I confirm the following:
1. Possible strategy :
1.1. Appeal in front of the Court of Revision:
There would be in our opinion grounds to file an appeal of the said decision in front of the Revision Court based on the fact that the Court has, in our opinion, wrongly considered that your claims were inadmissible.
As mentioned, we have found case law where, under similar circumstances and notwithstanding article 844 of the Code of civil procedure mentioned by the Court, the counter appeal of the defendant by writings filed after the initial time frame of 8 days to file an appeal had lapsed, had been taken into account by the Court (ruling dated 20 February 2007)..
We consider the Court has:
• wrongly applied the rules of civil procedure by ignoring common rules for appeal proceedings which provide that one can file a counter appeal by simple writings outside the time frame to file a main appeal (article 428 of the Code of Civil Procedure) and that a party may file new claims in defence to the main appeal lodge by the other party (article 431 para 2),
• violated your defence rights thus violating article 6 of the European Human rights convention.
These arguments would have to be researched more in depth, in coordination with the specialized lawyer.
However as discussed, even if the Court of Revision cancelled the ruling, a new ruling would have to be rendered by the Court of Appeal and it is not certain that it would rule differently on the issue of the holidays.
Also as previously mentioned, the Court could have declared your claims relating to school and possibly reduction of child support inadmissible due to the fact that they were new claims in appeal (not because you did not appeal the Juge Tutélaire's decision) and could not be considered as a defence to the main claim. So that the Court could render a decision whereby it would consider such claims inadmissible in its second ruling but based on the fact that they were "new" claims. This is the reason why it appears preferable to submit these "new" claims to the Juge Tutélaire (see below).
The time frame to file such an appeal in front of the Court of Revision is 30 days from the day of the decision. The appeal is lodged by a declaration with the Court clerk. Then we would have 30 days again to file the supporting application and evidence.
The decision would however not be rendered by the Court of Revision within 2 weeks, as you seem to have understood, but rather within approximately 6 months, bearing in mind that the case is legally considered as urgent. In the last two cases of the same nature we had have had, the time frame between the date of the appeal and the date of the actual Revision decision was seven months
Then the Appeal Court would have to rule again which, I expect, would also take approximately 6 months to one year.
As per your request, I sent an e-mail to the specialized French lawyer to obtain an assessment of her fees to prepare the legal argumentation for the supporting application. I will let you know as soon as she reverts to me.
1.2. New proceedings in front of the Juge Tutélaire:
Regarding the amount of child support and the choice of school, these issues could be deemed as "new" as the Juge Tutélaire did not rule on them in his initial 24 July decision since new facts occurred after he rendered his first ruling, i.e.:
- Child support: it is only because the Juge Tutélaire and the Court awarded you equal time with your daughter that it appears necessary to reduce the amount of child support accordingly,
- Choice of school: the dispute with Mrs. C. only appeared two months ago.
These issues could consequently be submitted to the Juge Tutélaire with a new application. We will be using the same argumentation as previously in the Appeal Court proceedings, which will help reduce the time to be spent to prepare the application.
Unfortunately however, we do not believe, unless new circumstances arise, that a claim regarding the holidays would be considered admissible at this stage by the judge since no new circumstances have arisen which would justify amending the Appeal Court ruling dated 8 June 2009, on this issue.
As per your request, I am immediately starting to prepare the application for the Juge Tutélaire. Hopefully I can forward it for your review beginning of next week (Monday or Tuesday).

Je fais suite à notre entrevue d’hier et après avoir analysé la décision de la Cour d’Appel du 8 juin 2008, je vous confirme ce qui suit :

1.1. Recours devant le Tribunal de Révision
A notre avis, il y aurait des motifs pour déposer une demande de révision de ladite décision devant Tribunal, basés sur le fait que la cour, à notre avis, a considéré vos requêtes comme irrecevables, de manière erronée.
Comme mentionné, nous avons trouvé des cas de jurisprudence où, dans des circonstances semblables et en dépit de l’article 844 de la procédure du Code Civil mentionné par le tribunal, le contre appel par conclusions de la partie intimée, déposé après expiration du délai de 8 jours pour faire appel, avait été pris en compte par le tribunal (arrêt du 20 février 2007).
Nous considérons que le tribunal a :
• Mal appliqué la règle de la procédure civile en ignorant la règle commune pour les procédures d’appel qui stipule que l’on peut déposer un contre appel simplement par conclusions en dehors de la limite de temps pour déposer appel (article 428 de la procédure du Code Civil) et les parties peuvent déposer de nouvelles demandes lors de la défense au principal recours en appel introduit par l’autre partie (article 431 para 2).
• Violé vos droits de défense, violant de ce fait l’article 6 de la convention Européenne des droits de l’homme.
Ces arguments devront faire l’objet de recherches plus approfondies, en coordination avec l’avocat spécialisé.
De toute façon comme nous en avions parlé, même si le Tribunal de Révision annule l’arrêt, une nouvelle décision devra être rendue par la Cour d’Appel et il n’est pas certain qu’elle déciderait autrement sur la question des vacances.
Aussi, tel que mentionné auparavant, le Tribunal pourrait avoir déclaré irrecevables vos demandes concernant l’école et une possible réduction des frais d’entretien de l’enfant, dû au fait qu’elles étaient des nouvelles demandes en appel (et non pas parce que vous n’avez pas fait appel de la décision du juge tutélaire) et ne pourrait pas être considérées en tant que défense de la demande principale. De ce fait le tribunal pourrait prendre une décision par laquelle il pourrait considérer de telles demandes irrecevables dans sa deuxième décision, mais basées sur le fait qu’elles sont de « nouvelles » demandes. C’est la raison pour laquelle il semble préférable de soumettre ces « nouvelles » demandes au Juge Tutélaire (voir ci-dessous).
Le laps de temps pour déposer un tel recours devant le Tribunal de Révision est de 30 jours depuis le jour de la décision. Le recours est introduit pas une déclaration auprès du greffier du tribunal. Ensuite nous aurions encore 30 jours pour le dépôt de la demande et des preuves qui l’étayent.
La décision ne serait de toute façon pas rendue par le Tribunal de Révision avant 2 semaines, ainsi que vous semblez l’avoir compris, mais plutôt approximativement 6 mois, gardant à l’esprit que ce cas est considéré comme légalement urgent. Dans nos deux derniers cas de même nature, le temps écoulé entre la date du recours et la date réelle de la décision de la révision fut de sept mois.
Ensuite, la cour d’appel devrait statuer de nouveau, ce que je pense, pourrait aussi prendre approximativement de 6 mois à un an.
Selon votre demande, j’ai envoyé un email à l’avocate spécialiste française pour obtenir une estimation de ses honoraires pour préparer l’argumentation légale de la demande. Je vous ferai savoir dès qu’elle m’aura répondu.
1.2 Nouvelles procédures devant le Juge Tutélaire :
Les demandes concernant la contribution à l’entretien et l’éducation et le choix de l’école peuvent être considérées comme nouvelles puisque le Juge Tutélaire n’a pas statué à ces propos dans sans ordonnance du 24 juillet et puisque des nouveaux éléments sont intervenus depuis qu’il a rendu son premier jugement, i.e. :
- Contribution à l’entretien et l’éducation de l’enfant : c’est seulement due au fait que le juge tutélaire et la cour d’appel vous aient attribué un temps égal avec votre fille qu’il semble nécessaire de réduire le montant de la contribution, en conséquence.
- Choix d’école : le différend avec Mme C. a surgi il y a seulement deux mois.
Ces demandes pourraient être soumises au juge tutélaire dans une nouvelle requête. Nous utiliserons la même argumentation que précédemment lors des procédures à la cour d’appel, ce qui aidera à diminuer le temps consacré à la préparation de la requête.
Néanmoins, nous nous croyons malheureusement pas, sauf nouvelles circonstances, qu’une nouvelle requête concernant les vacances sera acceptée par le juge à ce stade, puisqu’il n’y a pas d’éléments nouveaux depuis l’arrêt rendu sur ce point, par la cour d’appel le 8 juin 2009.
Selon votre demande, je commence immédiatement la préparation de la requête pour le juge tutélaire. J’espère pouvoir vous l’envoyer pour accord début de semaine prochaine (lundi ou mardi).
