I. PORODIČNI STATUS DETETA
1. Materinstvo i očinstvo
Materinstvo
Član 42.
Majka deteta jeste žena koja ga je rodila.
Utvrđivanje materinstva sudskom odlukom
Član 43.
(1) Ako žena koja je rodila dete nije upisana u matičnu knjigu rođenih kao majka deteta, njeno materinstvo može biti utvrđeno pravnosnažnom sudskom presudom.
(2) Pravo na utvrđivanje materinstva imaju dete i žena koja tvrdi da je majka deteta.
Osporavanje materinstva
Član 44.
(1) Materinstvo žene koja je upisana u matičnu knjigu rođenih kao majka deteta - može biti osporeno.
(2) Pravo na osporavanje materinstva imaju: dete, žena koja je upisana u matičnu knjigu rođenih kao majka deteta, žena koja tvrdi da je majka ako istom tužbom traži i utvrđivanje svog materinstva, te muškarac koji se po ovom zakonu smatra ocem deteta.
(3) Nije dopušteno osporavanje materinstva utvrđenog pravnosnažnom sudskom presudom.
(4) Nije dopušteno osporavanje materinstva posle usvojenja deteta.
(5) Nije dopušteno osporavanje materinstva posle smrti deteta.
Očinstvo
Član 45.
(1) Ocem deteta koje je rođeno u braku smatra se muž majke deteta.
(2) Ocem deteta koje je rođeno u roku od 300 dana od dana prestanka braka smatra se muž majke deteta iz tog braka ako je brak prestao smrću muža i ako majka nije sklopila novi brak u tom roku.
(3) Ocem deteta koje je rođeno u novom braku smatra se muž majke deteta iz tog braka.
(4) Ocem deteta koje je rođeno van braka smatra se muškarac čije je očinstvo utvrđeno priznanjem, odnosno čije je očinstvo utvrđeno pravnosnažnom sudskom presudom.
Ko može da prizna očinstvo
Član 46.
Očinstvo može da prizna muškarac koji je navršio 16. godinu života i koji je sposoban za rasuđivanje.
Kada se može priznati očinstvo
Član 47.
(1) Očinstvo se može priznati samo ako je dete živo u trenutku priznanja.
(2) Izuzetno, priznanje očinstva proizvodi dejstvo iako je dato pre rođenja deteta, ako se dete živo rodi. | Translation - French

Article 42
La mère de l’enfant est la femme qui l’a mis au monde.
Etablissement de la maternité par décision judiciaire
Article 43
(1) Si la femme qui a mis au monde l’enfant n’est pas inscrite sur le registre des naissances comme mère de l’enfant, sa maternité peut être établie par une décision judiciaire passée en force de chose jugée.
(2) Le droit à l’établissement de la maternité appartient à l’enfant et à la femme qui affirme être la mère de l’enfant.
Contestation de la maternité
Article 44
(1) La maternité d’une femme inscrite sur le registre des naissances comme mère de l’enfant peut être contestée.
(2) Le droit à la contestation de la maternité appartient à : l’enfant, la femme inscrite sur le registre des naissances comme mère de l’enfant, la femme qui affirme être la mère de l’enfant, dans le cas où cette dernière porte plainte et demande en même temps l’établissement de la maternité, et l’homme qui est considéré comme père de l’enfant sur base de la présente loi.
(3) Il est interdit de contester la maternité établie par une décision judiciaire passée en force de chose jugée.
(4) Il est interdit de contester la maternité après l’adoption de l’enfant.
(5) Il est interdit de contester la maternité après la mort de l’enfant.
Paternité
Article 45
(1) L’enfant né pendant le mariage a pour père le mari de sa mère.
(2) L’enfant né dans les 300 jours qui suivent la dissolution du mariage a pour père le mari de sa mère, dans le cas où la mort du mari a mis fin au mariage et que la mère n’a pas contracté un nouveau mariage dans le délai mentionné.
(3) L’enfant né après le remariage de sa mère a pour père le nouveau mari de sa mère.
(4) L’enfant né hors mariage a pour père l’homme qui a reconnu sa paternité ou dont la paternité a été établie par une décision judiciaire passée en force de chose jugée.
Qui peut reconnaître la paternité
Article 46
La paternité peut être reconnue par un homme qui a atteint l’âge de 16 ans et qui est capable de raisonner.
A quel moment peut-on reconnaître la paternité
Article 47
(1) La paternité peut être reconnue uniquement si l’enfant est vivant au moment de la reconnaissance.

Beograd - Komisija za zaštitu konkurencije do polovine jula trebalo bi da utvrdi da li će belgijski Delez, kupovinom lanca Maksi prodavnica, ostvariti dozvoljenu koncentraciju ili preti opasnost da posledica te transakcije bude dominantan položaj kojim se ograničava, sprečava ili narušava konkurencija na srpskom tržištu. Procedura je mogla da traje i kraće, oko mesec dana, da je prihvaćeno utvrđivanje tržišnog udela po skraćenom postupku. U Komisiji, međutim, kažu da podnosilac prijave, Delez, nije dostavio dovoljno podataka i uverljivih dokaza o svojoj tržišnoj i finansijskoj snazi, kao i da su podaci o tržišnom udelu Maksija i njegovih glavnih konkurenata na domaćem tržištu nedovoljno ubedljivi, zbog čega je moralo da se pređe na utvrđivanje po službenoj dužnosti, što je postupak koji traje tri meseca. | Translation - French

Delhaize attendra longtemps
Belgrade – D’ici la mi-juillet, la Commission pour la protection de la concurrence devrait établir si le groupe belge Delhaize pourra réaliser l’achat de la chaîne de magasins Maxi sans enfreindre la concentration d’entreprises autorisée ou bien s’il existe un danger qu’une des conséquences de cette transaction soit la position dominante de Delhaize sur le marché serbe qui limiterait, empêcherait ou compromettrait toute concurrence. Cette procédure aurait pu être plus courte - un mois environ - si on avait accepté de déterminer la part du marché par voie raccourcie. Cependant, Delhaize, qui a annoncé la concentration d’entreprises, n’a pas, d’après la Commission, fourni des données suffisantes et des preuves convaincantes sur son pouvoir de marché et sur son pouvoir financier. Les données relatives à la part de marché que détient Maxi et celle que détiennent ses principaux concurrents sur le marché local ne sont pas suffisamment convaincantes. Успостављање дипломатских односа
На Берлинском мировном конгресу, 1878. године, призната је самосталност и независност Кнежевине Србије. Новостечено међународно признање пропраћено је успостављањем дипломатских односа са читавим низом европских држава.
Влада Јована Ристића успоставила је званичне односе са Краљевином Белгијом 1879. године. На челу белгијске дипломатске мисије био је барон Емил де Борхграв, генерални конзул до 1884. и посланик до 1889. године, по струци правник, заинтересован за литературу и етнографију. Задатак конзула, с обзиром на војну снагу Белгије и на њену удаљеност од Србије, није био политичке, већ искључиво економско-стратешке природе.
Барон де Борхграв је, почев од 1882. године, писао извештаје о Србији који су скренули пажњу на многе, до тада непознате, чињенице европској јавности и објављени су као засебна књига 1883. године. Ова књига је, у то време, сматрана за једну од најпотпунијих о

L’établissement des relations diplomatiques
L’autonomie et l’indépendance de la Principauté de Serbie furent reconnues au Congrès des Nations de Berlin en 1878. Cette reconnaissance internationale nouvellement acquise fut suivie de l’établissement de relations diplomatiques avec toute une série d’Etats européens.
En 1879, le gouvernement de Jovan Ristic établit des relations diplomatiques régulières avec le Royaume de Belgique. Le baron Émile de Borchgrave, Consul général jusqu’en 1884 et Ministre résident jusqu’en 1889, fut à la tête de la mission diplomatique belge. Juriste de formation, il s’intéressait également à la littérature et à l’ethnographie. Compte tenu de la puissance militaire de la Belgique et de son éloignement géographique de la Serbie, le rôle du Consul n’était pas de nature politique mais uniquement économique et stratégique.
A partir de 1882, le baron de Borchgrave rédigea des rapports sur la Serbie qui attirèrent l’attention du public européen sur maints faits jusqu’alors méconnus, et qui furent publiés sous forme de livre en 1883. A l’époque, ce livre fut considéré comme un des livres les plus exhaustifs sur la Serbie. |
