Source text - English A devotee asked Swami “The Brahmin priest is collecting about one lakh rupees as fees for performing the rituals after the death. Is this justified for your caste?” Swami replied:-- The priest is Brahmana. But every Brahmana is not priest. Of course, if a person in a caste behaves wrongly, it reflects on the entire caste. I condemn this behavior of the priest as he is looting the society through exploitation. This specific case is certainly opposed by Me. At the same time, every exploitation in the society and consequent looting everywhere in all walks of life of all the people should be equally condemned. Every job holder and every businessman is looting the society through exploitation. I am not supporting this specific case, since generally the exploitation exists everywhere in the society. I am only saying that by controlling one case, society is not liberated from the exploitation. Let us start criticizing exploitation of the society from the priest and my appeal is only not to stop here itself, by which the use will be very little. The priest is exploiting the society by creating the fear about the hell and by saying that the ritual conducted by him saves the departed soul from hell. An atheist will deal this case in the beginning itself by saying that the hell, which cannot be shown by anybody does not exist and therefore the subsequent created fear for hell need not be exploited through the ritual. Since, the hell is non-existing, the fear is false and the subsequent ritual to remove the fear also becomes false by which one can escape the hell as per the version of the priest. All this is the approach of the atheist to solve this type of looting through exploitation. But, my approach to criticize this exploitation and its solution is totally different. I say that the hell exists, the fear for hell also should exist and the ritual should be performed to remove the fear for hell certainly. The ritual is certainly capable of protecting anybody from the hell. At the same time, the priest is definitely exploiting this concept and is looting the society because the priest is not performing the ritual in the right spirit and the priest is asking fees for performing the ritual. These two points are wrong. The first wrong point is absence of the right way of performing the ritual. The second wrong point is asking fees after performing the ritual. The right way of performing the ritual is to create knowledge and devotion about God through the ritual. The priest is reciting the prayers in Sanskrit, which is not known to the performer. Veda, the holy scripture, was in Sanskrit since it was written by sages, whose mother tongue was Sanskrit language. God knows all the languages, since He is omniscient. The priest should read the prayers in the mother tongue. At least, the priest should explain the meaning of the prayers to create divine knowledge through which devotion develops. The priest himself does not know Sanskrit and he is incapable of the explanation. He wasted all the time in reciting the prayers without seeing the book. In the old time, there was no technology of writing and therefore such recitation was essential to preserve Veda. Now, Veda is well preserved since it is printed in the form of a book. Therefore, the priest should use the book for recitation and should explain the meaning of the prayers. Other religions like Islam and Christianity are blessed since the scriptures are in their mother tongue and the priest reads the prayers with the help of book. You need not worry about the statement that one should not use the book [Likhitapaathakah..]. It is only a verse created by some scholar and the same verse also says that the priest should know the meaning of the prayers [Anarthajnah]. The priest should spend all the time in learning the Sanskrit language so that he can explain the meaning of the prayers. He should not waste the time in practicing blind recitation. If this reformation is implemented, Hinduism will be alive once again. The essence of ritual is only to propagate divine knowledge and devotion and not blind recitation of specific Sanskrit prayers. If this specific Sanskrit prayer alone can save the soul by mere recitation, it should have been made universal by the will of God. If such facility is confined to Hindus only, God becomes partial and cannot be claimed as father of the entire humanity. The essence of these Sanskrit prayers, which are divine knowledge and devotion, exists in every prayer of all religions in different languages. Thus, the essence is universal but not the language. Today in Hinduism, this essence is lost and therefore the ritual becomes ineffective and cannot save the departed soul. The devotion flowing in the prayers through the knowledge of the meaning alone can save the soul from hell. The priest is demanding the fees for the useless performance of the ritual. He should not ask the fees even if the ritual is performed in the right way. It is a double crime. Collection of fees is not a rule as per Dharma Shastra, which says that donation of money is a rule but not the collection of fees [Adya trishuniyamah]. The priest should perform the ritual in the right way and inspire the performer with divine knowledge and devotion. He should receive the fees given by the performer as per his capacity and interest. There should not be any demand from the priest. The priest may argue about his livelihood in such case. I assuredly promise that the priest will receive thousand times more money from the society, since God is pleased with him because the duty of the priest is perfectly performed. The fees collected by demand is bad money and will not give happiness and success in his family. The bad money earned by corruption and exploitation will always give tragic end in the case of anybody. If you perform your duty in this right path, the performer will certainly reward you even beyond his capacity due to divine inspiration. The performer is paying the priest in a forced way only due to fear and not with full willingness since he is not appreciating the meaning of the ritual. If the priest is not realizing this truth and does not change his false way, the solution is that the performer should refuse such useless ritual and conduct the ritual in the real sense. He can invite some good devotees and perform the prayers in his mother tongue for the protection of the departed soul. Certainly, such performance of ritual will save the departed soul because the real essence of the ritual is implemented. If the performer of the ritual is also foolish and is trapped by the fear, let the departed soul take Sanyasa before death and there is no need of any ritual for a Sanyasin after death. Thus, one can save one lakh rupees even if his son is foolish following the blind and wrong tradition. In fact, everybody is expected to take sanyasa in old age. The Shastra says that one should follow all the four ashramas before death and never recommends that one should die after the second asharama, which is the state of house holder. Actually, the departed soul is said to be directed in one of the two ways called as Shukla and Krishna paths [Shukla Krishna gateehyete…Gita]. In the first Shukla path, the soul reaches God and there is no need of food for the soul in this path [Nahi tenapathaa tanutyajah….]. The second Krishna path is sub-divided into three parts. The highest part is heaven and there is no need of food and water in heaven [Ubheteertvaa Ashanaayaa….]. The next lower part is Pitruloka and here also there is no need of food because the soul exists by the energy supplied from the moonlight [ Nirvishtasaaraam pitrubhih himamshoh…]. The next lowest part is hell and here also the food and water are denied and the soul suffers with hunger and thirst [ Jaayasva mriyasva…]. Therefore, the departed soul does not require food and water after the death because the departed soul is possessing energetic body only, which does not require any materialistic food. All the food given to the priests in the ritual is only to please the priests, the deserving scholars of Vedic knowledge, so that by such deed of good donation to devotees, the departed soul gets protection from God. Then, why a lie is told that the food given here to the priests reaches the departed soul? It is only Arthavada, which means a false statement given for a good purpose. By this, even a greedy fellow performs the charity to deserving priests and devotees due to fear that the departed soul may starve with hunger. This Arthavada is exploited by the present undeserving priests to extract huge amount of money from the ignorant people. It is better to reveal the truth so that the charity can be propagated in the true sense, since it is also associated with the protection of soul through charity to deserving devotees. When the protection of departed soul is achieved through right path also, what is the need of this false path of Arthavada, which allows the possibility of exploitation? In the ritual after death, a cow is donated to the deserving priest and the Arthavada here is that the departed soul will cross the river before hell. Here the charity is encouraged and crossing the river is only a lie created for good purpose. Similarly, an young bull is released in the ritual so that it helps the growth of race of cows through fertilization. Generally, the bulls are made incapable of fertilization and are used in agriculture. For the sake of the growth of cows such charity is encouraged through Arthavada. Nobody will do such good charity because everybody is interested in his own selfish growth of agriculture. All these good deeds of charity help the departed soul and hence the charity can be also achieved through revealing truth and there is no need of Arthavada. Arthavada is exploited and the undeserving priest is benefited. This donation to undeserving receiver is a sin and in fact the departed soul will be tortured more. The deservingness of the receiver is the essence of charity to give good result. If the deserving receiver is not available, you can postpone the ritual till the deserving receiver is available. The ignorant people are not giving importance of this aspect. They are mostly bothered about performing the ritualistic charity on the date of the death of the departed soul. The place and time are not important for the charity. Now the atheist may argue that the hell does not exist anywhere in the space and thus there is no need of these rituals. I could not show the presence of hell to the atheist and equally he did not show the absence of hell to me also, since the space is infinite. Moreover, you cannot conclude that all invisible items are non-existent. The cosmic energy is invisible to our eyes but it exists and becomes visible through powerful microscope. The microscope is the special instrument to show the existence of invisible cosmic energy. Similarly, the super power achieved by penance or God’s grace is special instrument to see the upper worlds. The hell may be near but is invisible due to lack of special instrument. The hell may be visible but may exist somewhere in the infinite space. Both of us are incapable of showing the presence and absence of the hell to each other and this results in 50-50 probability of both presence and absence. A blind person is walking and one says that fire is before him and the other says that there is no fire. If the blind person is wise enough, he will go back after analyzing the 50-50 probability. Even if he goes back, there is no harm to him assuming that the fire is absent. If he moves forward, he may be burnt, in case, fire exists. Therefore, the wise person will believe the existence of hell and will perform the rituals in the right sense for the sake of departed soul. In fact, the priest will go to hell, if the ritual is not done in proper way and if he demands the fees. The invisible need not be permanently unimaginable. The invisible may become visible through special techniques and then may become imaginable. The invisible may remain unimaginable as long as it is not visible. The invisible may remain unimaginable for ever if it is not visible at any time. The boundary of the universe is always invisible and remains unimaginable forever. The permanently unimaginable item remains invisible always like the boundary of the space. The temporarily unimaginable item like cosmic energy may be invisible for some time, but, when it becomes visible with special technology, it becomes imaginable. You may imagine some point of space as the boundary of this universe. But, that imagined point of space is not the last spatial point because such last spatial point can never be achieved even by imagination. If you claim that you have imagined the last spatial point, the immediate question will be “What is present after that last spatial point?”. You have to say that some more spatial points exist after your imagined last spatial point. In such case your imagined spatial point is not the last point. Therefore, the boundary of space is always unimaginable. Since God is beyond space, if you have reached the boundary of the space, you have reached God. Since you cannot reach the boundary of space even by imagination, God is always unimaginable. A miracle establishes the existence of permanently unimaginable item. A miracle is the word used for a group of imaginable and visible components through which the existence of hidden unimaginable and invisible component is established. The tender boy, his tender finger, the mountain and the process of lifting are visible and imaginable. All these items indicate the absence of vision and imagination of logical process of lifting of the mountain by a tender boy. Since the logic fails in this process, the process of such lifting becomes unimaginable. Unimaginable is always invisible because an item that cannot be touched by even imagination can never be touched by eyes. Though the process of lifting a mountain by the boy is visible, the hidden logical process of such lifting becomes invisible and unimaginable. This logical process remains always invisible and always unimaginable. Therefore, the permanently unimaginable item is always invisible. Similarly, in the performer of this process, the unimaginable God is hidden and is invisible, though the boy is visible and imaginable. By seeing the boy, you can say that you have seen the unimaginable God, because you have assumed the boy as the unimaginable God, who is hidden in him only. Therefore, the Vedic statement that one blessed soul has seen God is valid [Kaschit dheerah…]. Therefore, we can say that inference succeeds in giving the knowledge of all the characteristics of fire. But in the case of miracle, only the existence of the unimaginable item is known and any characteristic of the unimaginable item is not known. Therefore, the inference is also a failure in giving the characteristic knowledge of the permanently unimaginable item. If the existence is also not given here, nobody even recognizes and accepts the unimaginable item, which is God. Hence, Veda says that only the existence of God is revealed and no other characteristic knowledge of God is attained. Translation - Tamil 26-1-2010 அன்று சுவாமியின் தெய்வீக அருளுரை “அந்த பிராமண குருக்கள் இறந்ததற்கு பின் செய்யப்படும் சடங்கு சம்பிரதாய பூஜைகளைச் செய்து கொடுக்க ஒரு லட்சம் ரூபாய் வரை வாங்குகிறார். உங்கள் ஜாதிப்படி இது நியாயமானதா சுவாமி, நீங்களே சொல்லுங்கள்?” என்று ஒரு பக்தர் சுவாமியிடம் கேட்டார். சுவாமியின் பதில்:-- அந்த குருக்கள் ஒரு பிராமணர் தான். ஆனால் பிராமணர்கள் அனைவரும் குருக்கள் இல்லை. நிச்சயமாக, ஒரு குறிப்பிட்ட ஜாதியைச் சேர்ந்த ஒரு நபர் தவறாக நடந்து கொண்டால், அது அந்த ஒட்டுமொத்த ஜாதியையே பாதிக்கும். இப்படி சமுதாயத்தை தன் சுயநலத்துக்காக சுரண்டிக் கொண்டிருக்கும் அந்த குருக்களை நான் வன்மையாக கண்டிக்கிறேன். இந்த குறிப்பிட்ட செயலை நான் முழுவதுமாக எதிர்க்கிறேன். இதே போல், சமுதாயத்தில் அனைத்து மக்களின் வாழ்விலும் ஏற்படும் தொடர்ச்சியான மோசடிகளும், ஒவ்வொரு சுயநலமான சுரண்டலும் கண்டிக்கத்தக்கவை. பணி செய்யும் நபராக இருந்தாலும், தொழில் அதிபராக இருந்தாலும் அவரவர் பங்குக்கு தனது சுயநலமான செயல்பாட்டின் மூலம் சமுதாயத்தை கொள்ளை அடித்துக் கொண்டு தான் இருக்கிறார்கள். சமுதாயத்தின் எல்லா இடங்களிலும் சுரண்டல் நிலவும் சூழ்நிலையில், இந்த குறிப்பிட்ட விஷயத்தை நான் ஆதரிப்பதாக எண்ணக்கூடாது. அதாவது இந்த ஒரு விஷயத்தை நாம் கட்டுப்படுத்தி விடுவதால் சுரண்டலில் இருந்து இந்த சமுதாயத்தை விடுவித்துவிடவும் முடியாது என்பதைத் தான் நான் இங்கு வலியுறுத்துகிறேன். இந்த குருக்களில் ஆரம்பித்து இந்த சமுதாயத்தை நாம் விமர்சிக்கத் தொடங்கலாம், ஆனால் இதோடு மட்டும் நின்றுவிட்டால் இதன் பயன் மிகச்சிறியதாகவே முடிந்துவிடும் என்பது எனது கோரிக்கை. நரகத்தை பற்றிய பயத்தை ஏற்படுத்தி, இறந்த ஆத்மாக்களை நரகத்தில் இருந்து காப்பாற்றவே தாம் இந்த பூஜைகளைச் செய்வதாகக் கூறி இந்த சமுதாயத்தில் இருந்து அந்த குருக்கள் சுரண்டிக் கொண்டிருக்கிறார். இதே விஷயத்தை ஒரு நாத்திகவாதியிடம் சொல்லியிருந்தால், யாராலும் காண்பிக்க முடியாத ஒரு நரகத்தை எப்படி நம்புவது என்று கூறி, அதனால் ஏற்படுத்தப்படும் பயத்தைப் போக்க இந்த பூஜையும் தேவையில்லை என்று ஆரம்பத்திலேயே சமாளித்திருப்பார். அவரைப் பொருத்தவரை, நரகம் என்று ஒன்று நிஜமாகவே இல்லை என்கிற போது, அதைப் பற்றிய பயமும் தேவையில்லாதது. அந்த குருக்கள் சொல்வது போல், அந்த பயத்தைப் போக்கி ஒருவர் நரகத்துக்கு போவதைத் தவிர்ப்பதற்காக செய்யப்பட வேண்டிய பூஜையும் தேவையில்லாதது தான். சுரண்டலின் மூலம் சுயநலமாகக் கொள்ளை அடிப்போரைத் தவிர்ப்பதற்காகத் தான் நாத்திகவாதிகள் இது போன்ற அணுகுமுறையைக் கொண்டிருக்க்கிறார்கள். ஆனால் இந்த மோசடியை விமர்சிப்பதற்கும் இதற்கான தீர்வைப் பெறுவதற்கும் நான் கையாளும் அணுகுமுறை ஒட்டுமொத்தமாகவே வித்தியாசமானது. நரகம் உண்மையில் இருக்கிறது, நரகத்தைப் பற்றிய பயமும் இருக்க வேண்டும், நரகத்தைப் பற்றிய பயத்தைப் போக்க அந்த பூஜையும் செய்யப்பட வேண்டும், இது தான் எனது நம்பிக்கை. நிச்சயமாக ஒருவர் நரகத்துக் செல்வதில் இருந்து இந்த பூஜை பாதுகாக்கிறது. அதே சமயத்தில், அந்த குருக்கள் சரியான கருத்துணர்வுடன் அந்த பூஜையை செய்யாமல், அதனை செய்து கொடுக்க பணமும் கேட்பதால் இந்த நம்பிக்கையைப் பயன்படுத்தி சமுதாயத்தை ஏமாற்றுகிறார். இந்த இரண்டு செயல்களுமே தவறானவை. சரியான கருத்துணர்வுடன் பூஜையை செய்யாதது ஒரு தவறு. பூஜையை செய்வதற்காக பணம் கேட்பது இரண்டாவது தவறு. பூஜையின் மூலம் இறைவனைப் பற்றிய அறிவையும் பக்தியையும் உருவாக்குவதுதான் பூஜையை செய்வதற்கான சரியான நோக்கமாக இருக்க வேண்டும். குருக்கள் மந்திரங்களை சமஸ்கிருதத்தில் ஓதினால், அது பூஜையை செய்ய வந்தவருக்கு புரியவே புரியாது. சமஸ்கிருதத்தை தாய் மொழியாகக் கொண்டிருந்த முனிவர்களால் எழுதப்பட்டதால், புனித நூல்களான வேதங்கள் சமஸ்கிருதத்தில் உள்ளன. கடவுள் எங்கும் நிறைந்தவராக இருப்பதால், அவருக்கு எல்லா மொழிகளும் தெரியும். மந்திரங்களை குருக்கள் தாய் மொழியில் ஓதினால் எவ்வளவு நன்றாக இருக்கும். அவர் அந்த மந்திரங்களின் அர்த்தங்களையாவது கூறினால் தானே, அது பக்தியை வளர்க்கவாவது உதவும். குருக்களுக்கே சமஸ்கிருதம் சரியாகத் தெரியாது, அவர் எப்படி விளக்கம் கொடுப்பார். புத்தகத்தைப் பார்க்காமல் ஓதி ஓதியே அவருடைய பல நேரத்தை வீணாக்கிவிட்டார். அந்த காலத்தில், எழுதுவதற்கு எந்த தொழில்நுட்ப வசதியும் கிடையாது, அதனால் அவர்கள் வேதங்களை பத்திரப்படுத்தி வைத்திருந்தனர். ஆனால் இன்று அவற்றை புத்தகமாக அச்சிட்டு வேதங்களை நல்லபடியாக பாதுகாத்துக் கொண்டிருக்கிறோம். அதனால் குருக்கள் அந்த புத்தகத்தை வைத்துக் கொண்டே மந்திரங்களை ஓதி, ஜெபங்களின் அர்த்தத்தையும் விளக்குவதுதான் நல்லது. இஸ்லாம் கிறிஸ்தவம் போன்ற மதங்களின் புனித நூல்கள் தாய் மொழியில் இருப்பதாலும், அம்மதங்களின் மதகுருக்களும் அவற்றின் உதவியுடனே ஜெபங்கள் செய்வதாலும் அந்த மதங்கள் சிறப்பாக வளர்ந்து வருகின்றன. [லிகிதாபாதகா..] நூலைப் பயன்படுத்தக்கூடாது என்ற வாக்கியத்தைப் பற்றி நீங்கள் கவலைப்பட வேண்டாம். அது ஏதோ ஒரு மேதாவி சொல்லிச் சென்ற வாக்கியம் தான், அதே வரியில் தொடர்ந்து வாசித்தால் [அனர்த்தஜ்னா] என்று கூறப்பட்டுள்ளது, அதாவது பூஜை செய்பவர் அதன் அர்த்தத்தையும் தெரிந்திருக்க வேண்டும். மந்திரங்களின் விளக்கத்தை கூற வேண்டுமானால் ஒவ்வொரு குருக்களும் சமஸ்கிருத மொழியைக் கற்றுக் கொள்வதற்கு அதிகளவு நேரத்தை செலவளிக்க வேண்டும். குருட்டுத்தனமாக மனப்பாடம் செய்து ஒப்பித்துப் பழகுவதில் தன்னுடைய நேரத்தை வீணடிக்கக் கூடாது. இந்த சீர்திருத்தம் செயல்படுத்தப்பட்டால், இந்துத்துவம் மீண்டும் உயிர் பெரும். கடவுளைப் பற்றிய அறிவையும் பக்தியையும் ஏற்படுத்துவதற்காகத்தான் நாம் பூஜை செய்கிறோம், அது குறிப்பிட்ட சமஸ்கிருத மந்திரங்களை குருட்டுத்தனமாக ஒப்பிப்பதால் எந்த பயனும் அளிக்கப்போவதில்லை. குறிப்பிட்ட ஒரு சமஸ்கிருத மந்திரத்தை வெறுமனே ஓதினாலே ஒரு ஆத்மாவை காப்பாற்றிவிடலாம் என்றால், அதனை ஒரு சர்வதேச மொழியாக கடவுளே ஏற்படுத்தி இருப்பார். இது இந்துக்களுக்கு மட்டுமே உள்ள மொழி என்றால், கடவுள் ஒரு பாகுபாடு கொண்டவராகத்தான் இருப்பார், ஒட்டுமொத்த மனித இனத்துக்கே பகவானாக எப்படி விளங்குவார். தெய்வீக ஞானமும் பக்தியும் நிறைந்த இதே சமஸ்கிருத மந்திரங்களில் உள்ள சாராம்சம், பல்வேறு மொழிகளில் உள்ள எல்லா மதங்களின் ஒவ்வொரு ஜெபத்திலும் இருக்கிறது. எனவே சாராம்சம் தான் அனைவருக்கும் உரியது, அதைக் கொண்டிருக்கும் மொழியல்ல. ஆனால் இன்று இந்துத்துவத்தில், சாராம்சம் தொலைந்து போய்விட்டது, அதனால் பூஜைகளும் திறனற்றவையாக மாறிவிட்டன, அவற்றால் இறந்து போன ஆத்மாவை இரட்சிக்க முடியாது. அர்த்தம் நிறைந்த ஞானத்துடன் உள்ள மந்திரங்களில் பொங்கி வரும் பக்தியால் மட்டுமே நரகத்துக்கு செல்லும் ஒரு ஆத்மாவை இரட்சிக்க முடியும். ஒன்றுக்குமே உதவாத ஒரு பூஜைக்காக அந்த குருக்கள் பணம் கேட்கிறார். சரியான முறையில் செய்து கொடுத்தால் கூட அவர் அந்த பூஜைக்காக பணம் கேட்க்கக்கூடாது. சொல்லப்போனால், இரட்டைப் பாவம். தர்ம சாஸ்திரப்படி பணம் வசூலிப்பது ஒரு விதியல்ல, அதாவது பணத்தை நன்கொடையாகப் பெறலாம் ஆனால் கட்டணமாக வசூலிக்கக் கூடாது [ஆத்யா திரூஷூனியாமா]. அந்த குருக்கள் பூஜையை முறைப்படி செய்து கொடுத்து அதன் மூலம் பூஜை செய்ய வந்தவரை தெய்வீக ஞானத்திலும் பக்தியிலும் கவர்ந்திழுக்க வேண்டும். பூஜை செய்ய வந்தவரின் தகுதியையும் ஆர்வத்தையும் பொருத்துத் தான் கட்டணத்தைப் பெற்றுக் கொள்ளலாம். குருக்கள் தானாக எந்த வேண்டுகோளும் வைக்கக் கூடாது. அந்த விஷயத்தில் தன் வாழ்க்கை நிலைமையை எடுத்துச் சொல்லலாம். தன் கடமையை மிகச்சரியாக செய்து சேவை புரிந்தால் கடவுளும் அவர் மீது மகிழ்ச்சி கொள்வார், தனக்கு தேவையானதை விட ஆயிரம் மடங்கு அதிக பணத்தை சமுதாயத்தில் இருந்து கிடைக்கும்படி அருள்புரிவார் என என்னால் நிச்சயமாகக் கூறமுடியும். கட்டணமாகவும் கட்டாயமாகவும் வசூல் செய்யப்பட்ட பணம் தவறான பணம், அது மகிழ்ச்சியும் அளிக்காது, குடும்பத்துக்கும் ஆகாது. ஊழல் மூலமாகவும் சுரண்டல் மூலமாகவும் யார் சம்பாதித்தாலும் அவருக்கு அது நல்ல முடிவைத் தேடித்தரப் போவதில்லை. சரியான வழியில் உங்கள் கடமையை நிறைவேற்றினால், பூஜை செய்யவந்தவரும் தன் சக்திக்கும் மீறிய ஒரு நல்ல தட்சணையை இறைவனின் அருளால் வழங்கிச் செல்வார். பூஜை செய்ய வந்தவருக்கு பூஜை நடப்பது புரியவில்லை என்றால், அவர் முழு மனதோடு கொடுக்காமல் பயத்தினால் தான் கொடுப்பார், அதுவும் கட்டாயப்படுத்தப்பட்டு கொடுப்பார். இந்த யதார்த்ததை அந்த குருக்கள் உணர்ந்து, தன் போக்கை மாற்றிக் கொள்ளாவிட்டால், பூஜை செய்ய வந்த பக்தரும் இதுபோன்ற உதவாத பூஜைகளை விட்டுவிட்டு சரியான உணர்வுடனான பூஜையை நடத்திக் கொள்ள தயாராக வேண்டும். நல்ல பக்தியுள்ளவர்களையும் அழைத்து இறந்தவரின் ஆத்மா சாந்தி அடைவதற்கு தாய் மொழியிலேயே பூஜைகளை நடத்தலாம். பூஜையை நல்ல பக்தியான உணர்வோடு செயல்படுத்துவதால், நிச்சயமாக, இறந்தவரின் ஆத்மா சாந்தியடையும். பூஜையை நடத்துபவரும் முட்டாள்தனமாக, பயத்தால் ஆட்கொள்ளப்பட்டு இருந்தால், மரணத்துக்கு முன் அந்த ஆத்மா சந்நியாசம் புகுவது தான் அதற்கு தீர்வு. இறந்தவர் சந்நியாசியாக இருந்தால் எந்த பூஜையும் நடத்தத் தேவையில்லை. எனவே ஒருவரது மகன் முட்டாள்தனமாகவும் குருட்டுத்தனமான தவறான பாரம்பரியத்தை பின்பற்றுபவராகவும் இருந்தால் கூட இறப்பதற்கு முன் சந்நியாசம் போவதால் ஒரு லட்ச ரூபாயை சேமித்துக் கொடுக்கலாம். அனைவருமே அவர்களது வயதான காலத்தில் சந்நியாசம் போவது நல்லது தான். ஒருவர் தன் மரணத்துக்கு முன் நான்கு ஆசிரமங்களையும் பின்பற்ற வேண்டும் என சாஸ்திரம் கூறுகிறது. குடும்பஸ்தராக இருக்கும் இரண்டாவது ஆச்சிரமத்துடன் ஒருவர் இறந்து போகக் கூடாது என்பதையும் வலியுறுத்துகிறது. இறந்த ஆத்மா சுக்லா மற்றும் கிருஷ்ண பாதைகள் என்றவற்றில் [சுக்லா கிருஷ்ணா காதீயதே...கீதா] ஒன்றில் வழிநடத்தப்படும் என்பதாகத்தான் கூறப்பட்டுள்ளது. முதல் சுக்லா பாதையில், ஆத்மா இறைவனை அடைகிறது, இந்தப் பாதையில் ஆத்மாவுக்கு எந்த உணவும் தேவையில்லை [நஹி தேனாபதாதனுத்யஜா....]. இரண்டாவது பாதையான கிருஷ்ண பாதை மூன்று துணைப் பகுதிகளாக பிரிக்கப்பட்டுள்ளது. மேல்நிலையான பகுதி தான் சொர்க்கம், சொர்க்கத்தில் உணவோ நீரோ தேவையில்லை [உபதீர்தவா ஆஷனயா....]. அதனை அடுத்து கீழே உள்ள பகுதி பித்ருலோகா, இங்கேயும் உணவு தேவையில்லை, ஏனென்றால் ஆத்மாவுக்கு தேவையான சக்தி நிலவின் ஒளியில் இருந்து கிடைக்கிறது [நிர்விஷ்டசாரம் பித்ருபீஹ் ஹிமாம்ஷோ...]. அதனை அடுத்து கீழே உள்ள பகுதி தான் நரகம். ஆத்மாவுக்கு இங்கேயும் உணவோ தண்ணீரோ மறுக்கப்படுகிறது, அதனால் ஆத்மா பசியாலும் தாகத்தாலும் வாடுகிறது [ஜாயஸ்வா ம்ரியாஸ்வா]. எனவே இறந்த ஆத்மாவுக்கு தண்ணீரோ உணவோ தேவையில்லை. இறந்த ஆத்மாவுக்குள் இருப்பதே ஒரு அரூபியான அமைப்பு தான், அதற்கு திடமான உணவு எதுவும் தேவையில்லை. பூஜையின் போது குருக்களுக்கு வழங்கப்படும் உணவு, வேத ஞானம் பெற்ற அறிஞர்களான குருக்களை சந்தோஷப் படுத்தத்தான், அவர்களைப் போன்ற பக்திமான்களுக்கு நல்ல தட்சணை வழங்குவதால், இறந்தவரின் ஆத்மா இறைவனிடம் சரணாகதி அடையும் என்பதற்காகத் தான். பிறகு ஏன், குருக்களுக்கு வழங்கப்படும் உணவு இறந்தவரின் ஆத்மாவை சென்றடைகிறது என்கிற பொய் சொல்லப்பட்டது? அது ஒரு அர்த்தாவதா மட்டும் தான், அதாவது ஒரு நல்ல நோக்கத்திற்காக சொல்லப்பட்ட தவறான கூற்று. இதன் மூலம், ஒரு பேராசை கொண்ட ஒருவன் கூட இறந்த ஆத்மா பசியால் வாடுமே என பயந்து தன்னிடம் உள்ள உணவை தகுதியான குருக்களுக்கும் பக்தர்களுக்கும் தானமாக வழங்குவான் அல்லவா? இந்த அர்த்தாவதத்தை தகுதியற்ற இன்றைய கால குருக்கள் சாதாரண மக்களிடம் இருந்து கூட பெரியளவு பணத்தை மோசடி செய்து பெற்றுக் கொள்வதற்காக பயன்படுத்திக் கொள்கிறார்கள். நேர்மையான பக்திமான்களுக்கு தான தர்மங்கள் செய்வதன் மூலம் ஆத்மாவுக்கும் சரணாகதி கிடைப்பதுடன் தொடர்புடையதாகவே இருப்பதால், சரியான உணர்வுடன் தான தர்மங்கள் செய்யப்படுவதை மட்டும் ஊக்குவிக்க உண்மையை வெளிப்படுத்தி விடுவது நல்லது. சரியான பாதையில் இறந்த ஆத்மாவும் சாந்தி அடைந்துவிட்டால், மோசடி செய்ய வழிவகுக்கும், அர்த்தாவதத்துக்கான தவறான பாதையின் தேவை தான் என்ன? இறந்ததற்கு பின் செய்யப்படும் பூஜையில், நேர்மையான ஒரு குருக்களுக்கு ஒரு பசு ஒன்று தானமாக வழங்கப்படும், இதற்காக நரகத்துக்கு முன் உள்ள ஆற்றினை அந்த ஆத்மா கடந்து செல்லும் என்று ஒரு அர்த்தாவதா சொல்லப்பட்டது. இதனால் தர்மகாரியங்கள் வளர்ச்சியடையும், ஆற்றினை கடக்கும் என்று சொல்லப்பட்ட பொய்யும் நல்ல நோக்கத்துக்காகத் தான். அதுபோல, பூஜையின் போது ஒரு இளம் காளை ஒன்று அவிழ்த்து விடப்படுவதும், இனப்பெருக்கம் மூலம் பசுக்களின் இன வளர்ச்சியும் பெருகும் என்பதற்காகத் தான். பொதுவாக, காளைகள் இனப்பெருக்கத்திற்கு தகுதி இல்லாதவைகளாகக் கருதப்பட்டு விவசாயத்திற்கு பயன்படுத்தப்படுபவையாகும். பசுக்களின் வளர்ச்சிக்காக இது போன்ற தான தர்மங்கள் அர்த்தாவதத்தின் மூலம் உற்சாகப்படுத்தப்பட்டன. அனைவரும் அவரவரது சொந்த விவசாயத்தின் வளர்ச்சியில் மட்டும் ஆர்வம் செலுத்துவதால், யாருமே நல்ல தானதர்மங்களை செய்வதில்லை. இந்த தான தர்மங்களால் ஏற்படும் நற்செயல்கள் இறந்தவரின் ஆத்மாவுக்கு உதவுவதோடு, உண்மையைச் சொல்லிவிடுவதால் தானதர்மங்களும் நல்ல முறையில் செய்யப்படும், அர்த்தாவதத்துக்கான தேவையும் இல்லை. அர்த்தாவதா தவறாக பயன்படுத்தப்படுவதால், தவறான குருக்கள் பயனடைகிறார்கள். தவறான ஒருவருக்கு தட்சணை வழங்குவது ஒரு பாவம் தான், அதனால் இறந்தவரின் ஆத்மாவுக்கு அதிகமான சங்கடங்கள் தான் போய்ச் சேரும். தானத்தைப் பெற்றுக் கொள்பவரின் தகுதிதான் செய்யப்படும் தான தர்மத்தின் பலனாகும். சரியான நல்ல குருக்கள் கிடைக்காவிட்டால் சரியானவர் கிடைக்கும் வரை பூஜையை ஒத்திப்போடுங்கள். அக்கறையற்ற மக்கள் இந்த விஷயத்துக்கு முக்கியத்துவம் கொடுப்பதே இல்லை. அவர்களுக்கு தேவையானது எல்லாம் அந்த ஆத்மா இறந்து போன அதே நாளில் பூஜைகளுடனான தான தர்ம காரியங்களை செய்து விட வேண்டும் என்பது தான். தான தர்மம் செய்ய இடமோ நேரமோ அவசியமானதல்ல. அண்டசராசரத்தில் நரகம் என்பதே இல்லை என்பதால், இதுபோன்ற தானதர்மங்களுக்கான அவசியமும் இல்லை என்று நாத்திகவாதி வாதம் செய்யலாம். அண்டசராசரம் என்பது எல்லை அற்றது என்பதால், என்னால் எப்படி நரகம் எங்கிருக்கிறது என்பதைக் காட்ட முடியவில்லையோ அதுபோல அவராலும் நரகம் இல்லை என்பதை என்னிடம் காண்பிக்க முடியவில்லை. அதற்கும் மேல், கண்ணால் காண முடியாத எந்த Source text - English All India Bar Examinations Preparatory Materials Subject 3: 5 Constitutional Law Preamble The Preamble to the Constitution of India 10 (“the Constitution”) sets out the ideals and goals that the makers of the Constitution sought to achieve. A court may look into the terms of the Preamble when a doubt arises in interpreting the language used in a provision of the Constitution. This occurs when the language is capable of more than one meaning. Where the language of the other provisions of the Constitution is clear and unambiguous, the terms of the preamble cannot be used to qualify or cut down that enactment. The objectives specified in the Preamble are part of the basic structure of the Constitution, and may not be amended in exercise of the power in the Constitution in violation of the basic structure. (Keshavananda Bharti v. State of Kerala, AIR 1973 SC 1461) Illustration: The basic feature of secularism as envisaged in the Preamble is to mean that the state will have no religion of its own and all persons will be equally entitled to the freedom of conscience and the right freely to profess, practice and propagate the religion of their choice. (Indira Nehru Gandhi v. Rajnarain, AIR 1975 SC 2299) Part I: The Union and its Territory The Constitution provides that India is a union of states (A.1), and as such, one must keep in mind that the essential structure of the Constitution is federal or quasifederal in nature. (Automobile Transport (Rajasthan) Ltd. v. State of Rajasthan, AIR 1962 SC 1406) Parliament has the authority to form new states (A.2), to alter the territory or names of the states without their consent or concurrence, and to alter the area, boundaries, or names of existing states by a law passed by a simple majority. (A.3) Part II: Citizenship Part II of the Constitution relates to citizenship, and lays down the modes of acquiring citizenship of India at the time of commencement of the Constitution. A.11 vests Parliament with the power to regulate, by legislation, the right to citizenship. In exercise of this power, Parliament enacted the Citizenship Act, 1955. The Constitution clearly distinguishes between a ‘person’ and a ‘citizen’. Some fundamental rights are available only to citizens, whereas others are available to all persons, regardless of whether they are citizens. (Jaipur Udyog v. Union of India, AIR 1969 Raj 281) Illustration: A newspaper publishing company seeks to file a writ petition in the Supreme Court, claiming that its fundamental right to freedom of speech and expression provided in A.19(1)(a) has been violated. The company will not succeed, since a company cannot be a ‘citizen’, and the rights under A.19 are 25 provided only to citizens. Part III: Fundamental Rights A.12 defines ‘State’ for the purposes of Part III of the Constitution as including the Government and Parliament of India and the government and legislature of each of the states, as well as all local or other authorities within the territory of India or under the control of the Government of India. Whether or not a body is ‘state’ will have to be considered in each case, on the basis of the facts available, and considering whether the body is financially, functionally, and administratively dominated by or under the control of the government. Mere regulatory control, whether under statue or otherwise, would not make a body ‘state’. (Zee Telefilms Ltd. v. Union of India, AIR 2005 SC 2677) Illustration: A files a writ petition, arguing that the Board for Control of Cricket in India is ‘state’ within the meaning of A.12. The Board was not created under a statute; no part of the share capital of the Board was held by the government; practically no financial assistance was given by the government to meet the whole or entire expenditure of the Board; the Board’s monopoly on cricket in the country was not state-conferred or state-protected. The control of the government, if any, was only regulatory, and not administrative in nature. The Board is not ‘state’ under A.12. (Zee Telefilms Ltd. v. Union of India, AIR 2005 SC 2677) Laws in force in the territory of Indian before the coming into force of the Constitution, in so 15 far as they are inconsistent with the provisions of Part II, are void to the extent of such inconsistency; furthermore, the State is barred from making any laws that take away or abridge the rights conferred in Part III – any law made in contravention of this rule are, to the extent of such inconsistency, void. ‘Law’ for this purpose would include any ordinance, order, bye-law, rule, regulation, notification, custom or usage having within the territory of India the force of law. This rule, under A.13, would not apply to any amendment of the Constitution made under A.368. In some cases, however, the fundamental rights form part of the basic structure of the Constitution, and as such, may not be taken away by an amendment. (Keshavananda Bharati v. State of Kerala, AIR 1973 SC 1461) Right to Equality A.14 provides that the state will not deny to any person equality before the law and the equal protection of the laws in the territory of India. ‘Equality’ here means legal equality, and not natural equality; equality before the law means that among equals the law must be equal and must be equally administered, that like must be treated alike. Courts have upheld legislation containing apparently discriminatory provisions where the discrimination is based on a reasonable basis. The requirement of ‘reasonableness’ it that the classification must not be arbitrary, but must be rational. (Chiranjit Lal v. Union of India, [1950] SCR 869) Illustration: A was denied appointment to the A.15 prevents the State from discriminating against any citizen on grounds only of religion, race, caste, sex, place of birth, or any of them. The State may, however, make special provisions for: • Women and children (A.15(3)); • The advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes and Scheduled Tribes (A.15(4)); or • For the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes and Scheduled Tribes insofar as such provisions relate to their admission to educational institutions, including private educational institutions, whether aided by the State or not, other than minority educational institutions. (A. 15(5)) Illustration: The Rules of a Medical College provided that non-residents of the state where the college was located would have to pay a capitation fee for admission, whereas 35 residents would not. The court held that the discrimination was based on place of residence, and not on place of birth, and therefore, it did not violate A.15(1). (D. P. Joshi v. State of Madhya Bharat, AIR 1960 SC 1208) A. 16 provides for equality of opportunity for all citizens in matters relating to employment or appointment to any office under the State. Sub-clause (4), however, provides that this would not prevent the State from making any provision for the reservation of appointments or posts in favour of any backward class of citizens which, in the opinion of the State, is not adequately represented in the services post of principal at a government women’s college since he was a man. He challenged the college’s policy of appointing only women as principals of the college. The court held that the appointment of a lady principal in a women’s college or a lady teacher therein would not be violative of A.14 or A.16 because the classification is reasonable, and it has a nexus with the object sought to be achieved. (Based on Vijay Lakshmi v. Punjab University, 10 (2003) 8 SCC 440) Contract Act Subject 4: 5 Contract Law, including Specific Relief, Special Contracts, and Negotiable Instruments The Indian Contract Act, 1872 (“the Contract Act”) is not an exhaustive code. Its function is “...to define and amend certain parts of the law relating to contracts...” (Preamble). Where the Contract Act deals with an issue specifically, it is exhaustive on the subject. Where it does not, and no other authorities in Indian law are available, the courts may refer to the judgments of English Courts. (Bhagwandas Goverdhandas Kedia v. Girdharilal Parshottamdas and Co., [1966] 1 SCR 656) Definition of a contract (S. 2(h)): “an agreement enforceable by law is a contract.” The definition implies that all agreements are not contracts; an agreement must meet certain criteria in order to be enforceable by law and qualify as a contract. These are set out in Section 10 of the Contract Act: • Free consent of parties; • Competence of parties to contract; • Lawful consideration; • Lawful object; and • Not expressly declared void by law. A contract may be bilateral or unilateral. In a bilateral contract, two parties exchange promises, each promise forming the consideration for the other. In the case of a unilateral contract, a promise by one is exchanged for an act of forbearance on the part of the other. Illustration: A offers to give a reward of Rs. 45 10,000/- to anyone who finds her missing mobile phone. B finds the phone and returns it to A. A is bound to give B the reward money. This is a unilateral contract, where A makes a promise in exchange for an act of forbearance by the finder of the missing phone. Intention to Create Legal Obligation: Thought not expressly set out in the Contract Act, it is accepted by the courts that the parties to an agreement must have the intention to create legal obligations in order to give rise to a contract: “There are agreements between parties that do not result in a contract within the meaning of that term in our law.” (Balfour v. Balfour, [1919] 2 K.B. 571) Illustration: In the course of a casual conversation, A stated that he was willing to give £100 to anyone marrying his daughter with his consent. B married A’s daughter with his consent, and asked for the money. The court observed that it was not reasonable that 20 the defendant should be bound by such general words, and that there existed no intention to create a legal obligation. (Weeks v. Tybald, (1605) Noy 11) Formation of a Contract: Offer and Acceptance Two parties may enter into an agreement by the communication of a proposal and its acceptance. Such a proposal is called an ‘offer’, and once it is accepted, it becomes a promise. An assent to an offer is called an ‘acceptance’. An offer must be distinguished from an invitation to treat, or an invitation to make offers. Such a statement does not constitute a valid offer. Illustration: Goods were displayed in a shop, with the prices attached. This was held to be an invitation to treat, and not an offer. It was 40 not capable of conversion into a contract by acceptance. (Pharmaceutical Society of Great Britain v. Boots Cash Chemists (Southern) Ltd., [1952] 2 Q.B. 795) In an auction, each bid constitutes an offer, which may or may not be accepted. An auction, therefore, is merely an invitation to treat. An offer may be made to a particular individual (‘specific offer’), or to the world at large (‘general offer’). Illustration: A company stated in an advertisement that it would pay £100 to anyone who caught influenza after using its smoke balls thrice daily for two weeks. The company deposited the money in a bank account to show its sincerity. A lady, relying on the advertisement, used the smoke balls for the prescribed period. She caught influenza and sued for the reward. The company was held liable to pay, because there was an intention to create a legally binding obligation, and this was made clear to all persons in general (general offer). (Carlill v. Carbolic Smoke Ball Co., [1893] 1 Q.B. 256) An offer (and acceptance) must be definite and certain. If the offer or acceptance are not clear enough to permit the conclusion of the contract, they are not considered valid. S.29 of the Contract Act states: “Agreements, the meaning of which is not certain, or capable of being made certain, are void.” Illustration: The managing director of a company entered into an agreement with one of the company’s employees, to pay a certain amount of remuneration when the company was in a position to do so. The agreement was held to be void due to uncertainty. (Pushpabala Ray v. L.I.C. of India, AIR 1978 Cal. 221) An offer must be communicated to the other person in order for it to be valid. If I do not know of an offer, I cannot possibly accept it. Illustration: A and B are negotiating the sale of 40 A’s property to B over the telephone. After all the other terms have been negotiated and settled, A says “My final offer is Rs.40 lakhs. Will you buy the property for this price?” At the same time, though, the telephone disconnects, and B does not hear this statement. There is no offer, since A’s statement was not communicated to B. If a particular mode or time limit is specified for the acceptance of an offer, the acceptance will only be valid if made in that mode and within that time. If no such mode or time is specified, the acceptance must be made in a reasonable mode, and within a reasonable time. Illustration: A offers to buy B’s computer for Rs.30,000/-, and tells B to respond in writing to the offer. B tells A on the telephone that she would sell him the computer. A is not bound by B’s statement, since the ‘acceptance’ was not communicated in the prescribed mode. If the offeror accepts in a manner other than that prescribed, and does not protest within a reasonable time, the offeror is bound by the acceptance. Illustration: In the above illustration, if A tells B on the same telephone conversation that she agrees to buy the computer, and that she would send B the money immediately, A is bound by the acceptance, and cannot walk out of the bargain. If, in a unilateral contract, the offer demands an action, the other party only has to perform the action, and does not have to communicate an acceptance otherwise. Illustration: Where A offers a reward to the finder of some lost property, and B finds the lost property, B need not communicate the acceptance to A; merely returning the lost property to A is enough to constitute a valid contract. Communication of offer or acceptance must be made to the party directly, or the person authorised to receive communication by the party; communication to a third party or stranger will not suffice. In case of communication by a non- instantaneous mode of communication, such as post or email, (a) an offer is complete as against the acceptor when the offeror puts it in a mode of transmission outside the control of the offeror, and (b) an acceptance is complete as against the offeror when the acceptor puts it in a mode of transmission outside the control of the acceptor. About me

I am a Native Tamil Speaking Linguist. Basically I am an IT graduate. I easily learn any Software tools, that helped me in learning CAT tools easily. I have worked so far in CAT tools like SDL Trados, Microsoft Helium, Loc Studio, PO edit, Nokia Taipan, etc.

My Recent translation work on All India Bar Council Examination Preparatory materials has been a great experience for me in legal genre translations. This going to be a long term project in my career.

I own a full license for SDL Trados Studio 2009 and SDL Trados 2007 freelance Suite.

I have great years of professional experience in English to Tamil translation. My first two years I was working with a language service provider and a local language web portal. From there I have been working with many big projects like Microsoft Vista, Office 2007 translations for Microsoft Corporation.

Till now I am working for Nokia in all these years. I have translated My Nokia website, Nokia Model interfaces etc.

In Medical projects I have a vast experience in ICF translations, Medical questionaaires etc. My translations are served for companies like Daiichi Sankyo, Johnson & Johnson, Ranbaxy etc.

I do regular translations for Glaxo Smithkline.

Beyond all these successful ventures, I feel proud that now I work as Tamil Linguistic Expert (Remote Desktop) for a Mobile Keypad creation and Mobile Dictionary creation project. This is to come to the market by 2011.

I am much engaged on Wikipedia Articles translation to Tamil for Google on History, Biography, Science & Technology subjects.
