WITNESS STATEMENT OF XXXX XXXX
I Xxxx xxxx of xxxx xxxxcurrently at Her Majesty’s Prison and Youth Offending Institute Doncaster, Marshgate, Doncaster, DN5 8UX date of birth 29th September 1963, unemployed, WILL SAY AS FOLLOWS: -
1. I Xxxx xxxx am making this witness statement in response to the claim that has been brought against me by Sheffield City Council for possession of my property at xxxx Firshill Crescent.
2. I have considered the allegations against me but a lot of them are very old now and difficult for me to respond to. I have mental health difficulties and I find it hard to think back. I do not understand why Sheffield City Council did not bring these proceedings before if they really believed that I had done these things.
3. Firstly, it is said that I play my music too loud from my TV or radio but this is not true. My neighbours are against me and are always targeting me because I am different. They want me to give them money and as a refuse they pick on me. They know that I have mental health problems and psychiatric problems and they use this to try and get things from me as I am vulnerable.
4. It is also alleged that I bang on my neighbours doors asking for food money and other items and when this is refused I make offensive remarks. Again, this is not true. It is my neighbours who do this to me and then abuse me because of my mental health difficulties.
5. My neighbours also say that I, and visitors to my property, bang shout scream and swear loudly in my flat and the communal areas. The only time that I have shouted and screamed has been when I have been attacked by my neighbours. I would not ordinarily be noisy and I would not let visitors behave in this way. I do pray frequently and this may be heard but that is all. I do hear loud noises but sometimes I am not sure if this is to do with my mental health. The doctors know about my case and I want them to take me into hospital for treatment to stop the voices in my head.
6. The Council and my neighbours say that I repeatedly press the intercom buzzers of neighbouring flats to gain access to the communal block. There are no dates and time stipulated and I deny that I have done this frequently. I remember pressing the button once as I had lost my keys and wanted somebody to let me in. Nobody would open the door for me and they were doing it intentionally as they did not want to let me in.
7. Again, at some time between June 2006 to date I am supposed to have been in an intoxicated condition and causing a nuisance. I deny this. I do sometimes use khat and alcohol as this helps me to cope with the voices in my head. I do not feel that I have sufficient help and I know that I can do this sometimes to stop some of my symptoms. However, this just makes me drowsy, not aggressive. I have never harmed my neighbours but they are angry with me as I will not give them money and food. I know that I am ill but I do not hurt anybody at all. I only use alcohol and khat because nobody will help me. If I got proper treatment I am ready to stop both.
8. I am also told that between June 2006 to date that I have left the gas supply on, unlit within the property and this causes a nuisance, annoyance and a danger to my neighbours. I cannot remember this at all.
9. It is also denied that I have threatened Mr Fenney with a gun. This has never happened, I have never threatened her. I was arrested by the police and it was proved that I had done nothing wrong and did not have a gun. This is further example of my neighbours making lies up about me.
10. The rest of the allegations are the same. My neighbours are racist and do not like me. They steel from people and try to blame me. They are all liars and want to kick me out of my flat. They bring prostitutes home and underage girls to the property. They are worried that I will report them to the authorities as I have various people coming to my flat such as my social and support workers. They see people around and think that I will grass on them.
11. I deny that I have done anything wrong but I wish I could move away from this property. My neighbours hate me and make my life a misery. I just want to be moved once I am out of prison so that I do not have to deal with these people.
12. I can confirm that I copy of this witness statement has been translated to me and I am happy with the contents.

أنا xxxx ، أسكن في رقم xxxx ، فيرشيل كريسنت، مدينة شيفيلد، S4 7BT، ونزيل حاليا في السجن والمعهد الإصلاحي لصاحبة الجلالة الخاص بالشباب الخارجين عن القانون في مارشجيت، دونكاستر، DN5 8UX. تاريخ ميلادي هو 29 سبتمبر 1963م ، وأنا عاطل عن العمل، أدلي بأقوالي كما يلي:
1) أنا xxxx ، أدلي بأقوالي حول الدعوى المرفوعة ضدي من قبل مجلس بلدية مدينة شيفيلد بخصوص حيازتي لعقاري رقم xxxx ، فيرشيل كريسنت.
2) بعد مراجعتي للإدعاءات المذكورة في الدعوى ضدي،وجدت أن الكثيرمنها قديم جدا ومن الصعوبة عليّ أن أرد عليها، فأنا أعاني من مشاكل في صحتي العقلية وأجد صعوبة في تذكّر الماضي. وأنا لا أفهم لماذا لم يتقدم مجلس بلدية مدينة شيفيلد بإجراءات الدعوى من قبل إذا كانوا على يقين بأنني أنا الذي فعلت هذه الأشياء.
3) أولا: يدّعون أنني أشغــّل الموسيقى بصوت عالي جدا عبر التلفزيون والمذياع، وهذا غير صحيح. إن جيراني ضدّي ودائما ما يستهدفونني لكوني مختلف عنهم، يريدون مني أن أعطيهم نقودا وعندما أرفض يخلقون لي المشاكل. إنهم يعرفون أنني أعاني من مشاكل عقلية ونفسية ويستغلون هذا للحصول على أغراض مني كوني في موقع الضعيف.
4) ويدّعون أيضا بأنني أدق بعنف على أبواب منازل جيراني طلبا للأكل والنقود وأشياء أخرى، وعندما يرفضون أقوم بتوجيه عبارات مسيئة، وهذا أيضا غير صحيح. أنهم هم الذين يفعلون ذلك بي، مستغلين معاناتي من مشاكل في صحتي العقلية .
5) كما يدّعي جيراني بأنني وزوّاري في المنزل ندق بعنف ونصرخ ونصيح ونسبٌّ بصوت عالي في المنزل والأماكن العمومية، إن المرة الوحيدة التي صرخت وصحت فيها كانت عندما هاجمني جيراني ، وأنا في العادة لا أسبب إزعاج ولا أسمح لزوّاري بالتصرف بتلك الطريقة، وربما أنا أؤدي الصلاة باستمرار وقد يكون بالإمكان سماعها في الخارج، وهذا كل مافي الأمر. أنا أسمع أصوات عالية و مزعجة ولكن في بعض الأحيان أنا غير متأكد فيما أذا كانت تعود لصحتي العقلية. إن الأطباء على علم بصحتي العقلية وأريد منهم إدخالي إلى المستشفي للعلاج لإيقاف تلك الأصوات في رأسي.
6) يدّعي المجلس البلدي وجيراني بأنني أنا الذي أقوم بالضغط بشكل مستمر على زر الجرس الخاص بالشقق المجاورة لأتمكن من الدخول إلى المبنى المشترك. ولكن لم يُعطى أي تاريخ أو وقت، وأنا أنكر أنني أنا الذي فعلت هذا باستمرار. أنني أتذكر أنني ضغطت على الجرس مرة واحدة لأني نسيت مفتاحي وأريد من أحد ما أن يفتح لي الباب للدخول. لأ أحد منهم يود أن يفتح لي الباب للدخول ويفعلون ذلك متعمدين .
7) مرة أخرى، في بعض الأحيان بين يونيو 2006 وحتى الآن يدّعى أنني كنت في حالة سُكر وكنت أسبب إزعاج. أنني أنكر هذا الإدعاء. في بعض الأحيان أتناول "القات" والخمر كونهما يساعداني في التأقلم مع الأصوات التي في رأسي. أنا لا أشعر أنني أتلقى مساعدة كافية وأنا أعرف أنه بالامكان أن أكون قد فعلت ذلك في بعض الاحيان لإيقاف بعض الأعراض المصاحبة، ولكن هذا فقط يجعلني أشعر بالنعاس لا أن أكون عدوانياً. إنني لم أضر أحداً من جيراني ولكنهم هم غاضبون مني لأني لا أعطيهم ما يريدون من نقود وطعام. أنا أعرف أنني مريض ولكني لا أسبب ضررلأحد على الإطلاق. أنا أتناول الخمر و "القات" فقط لأنه لايوجد أحد يساعدني، وإذا تلقيت العلاج اللازم فأنني مستعد للإمتناع عن تناولهما.
8) كما تم إبلاغي بأنه بين يونيو 2006 وحتى الآن قمت بترك محبس الغاز مفتوحا وأطفأت الأضواء في المبنى مما سبب الإزعاج والغضب وعرضت الجيران للخطر. أنني لا أتذكر أنني فعلت ذلك أبداً.
9) أنني أيضا أنكر أنني قمت بتهديد السيدة فينّي بالسلاح. هذا لم يحدث أبداً. لم يحدث أنني هددتها. تم إعتقالي من قبل الشرطة وثبت أنني لم ارتكب أي ذنب ولم يكن لدي أي سلاح وهذا نموذج من الأكاذيب التي يروجّها جيراني عني.
10) بالنسبة لبقية الإدعاءات فإنها مثل بعضها البعض. إن جيراني عنصريون ولايحبونني، فهم يسرقون الناس ويحاولون أن ينسبون ذلك إليّ. إنهم جميعا كذابون ويريدون طردي من شقتي. وهم يجلبون العاهرات والبنات القاصرات إلى المبنى ويخافون من أن أقوم بالإبلاغ عنهم إلى السلطات بسبب أن زوّار كثر يأتون إلى شقتي مثل موظفي الدعم الإجتماعي الذين يتابعون حالتي، والذين عندما يرونهم يظنون أنني سأبلغ عنهم.
11) أنني أنكر أنني أرتكبت أي خطأ ولكنني أتمنى لو أستطيع الإنتقال بعيدا عن هذا المبنى. إن جيراني يكروهونني وجعلوا حياتي مزرية. أريد الإنتقال بمجرد خروجي من السجن لكي لا أعود أتعامل مع هولاء الناس.
12) بوسعي التأكيد بأن نسخة من محضر أقوال شهادتي هذا تمت ترجمتها إلي وبأنني راضٍ عن محتواها.
