4.1 Installation and Warranty Service. DISTRIBUTOR will be responsible for all
installation and warranty customer service for the Products delivered to end users by DISTRIBUTOR in the Territory. By way of example and not of limitation, this responsibility will require DISTRIBUTOR to:
a. expeditiously satisfy all legal customer requirements for installation and in-warranty service upon such Products; and,
b. furnish all labor and spare parts for such installation and in-warranty service
If DISTRIBUTOR provides COMPANY with reasonable evidence that DISTRIBUTOR has installed a replacement part for a part failing under warranty, COMPANY either will reimburse DISTRIBUTOR for its landed cost for the replacement part or will provide DISTRIBUTOR a replacement for that spare part at no charge. COMPANY may select either remedy at its sole discretion. If requested by COMPANY, DISTRIBUTOR will return parts replaced under warranty to COMPANY for inspection and concurrence as to the need for replacement and COMPANY will supply DISTRIBUTOR with all documents needed for such return according to national laws. DISTRIBUTOR will properly dispose of defective parts that are not returned to COMPANY and will comply with any directions of COMPANY concerning proper disposal. | Translation - Russian
4.1. Монтаж и гарантийное обслуживание. ДИСТРИБЬЮТОР будет нести ответственность за монтаж и гарантийное обслуживание Продукции, поставленной ДИСТРИБЬЮТОРОМ конечным потребителям на своей Территории. В частности, ДИСТРИБЬЮТОР, помимо прочего, отвечает за:
а) оперативное удовлетворение всех правомерных требований заказчиков по монтажу и техническому обслуживанию такой Продукции в пределах гарантийного срока, и,
б) предоставление необходимого персонала и всех запасных частей для такого монтажа и технического обслуживания в пределах гарантийного срока.
Если ДИСТРИБЬЮТОР предоставляет КОМПАНИИ разумные доказательства того, что ДИСТРИБЬЮТОР установил запасную часть вместо части, вышедшей из строя в течение гарантийного срока, КОМПАНИЯ либо возмещает ДИСТРИБЬЮТОРУ стоимость запасной части с учетом всех расходов по ее доставке, либо безвозмездно предоставляет ДИСТРИБЬЮТОРУ новую запасную часть. КОМПАНИЯ может выбрать тот или иной вариант по своему собственному усмотрению. По требованию КОМПАНИЯ ДИСТРИБЬЮТОР возвращает КОМПАНИИ части, замененные по гарантии, для осмотра и проверки необходимости их замены, а КОМПАНИЯ предоставляет ДИСТРИБЬЮТОРУ всю документацию, необходимую для такого возвращения в соответствии с национальным законодательством. ДИСТРИБЬЮТОР обязуется утилизировать в установленном порядке неисправные части, которые не полежат возврату в КОМПАНИЮ, и соблюдать все указания КОМПАНИИ относительно надлежащего порядка их утилизации.
