DISTRIBUTION AGREEMENT
Scope of the agreement and appointment
2.1 This Distribution agreement comprises along with this document the appendices indicated in Section 25 (collectively hereafter the “Agreement”).
2.2 The Distributor is granted the exclusive right to market, sell and distribute products specified in Appendix 1 (hereafter the “Goods”) produced by XXX in the territory of Germany and to the German Trade Groups outside Germany, provided that XXX has given its prior written consent regarding the countries outside Germany (hereafter the “Territory”). Notwithstanding the abovementioned, the Distributor does not have the rights to market, sell or distribute Goods in Finland, Sweden, Norway, Denmark, the Baltic countries and/or Russia. Any other markets are reserved for either XXX or other distributors used by XXX.
2.3 The Goods shall be marketed, sold and distributed under the YYY trademark or any other trademarks or private labels, which have been accepted by XXX in writing. For the sake of clarity it is stated that XXX does not grant any license to the Distributor to use any of XXX’s trademarks. Neither party shall directly or indirectly use the other party’s name, trademark or any other exclusive rights in the packaging, as a part of its company or trading name or otherwise.
Distributor’s general obligations
3.1 The Distributor undertakes to comply with all governmental laws, rules and regulations pertaining, among others, to the processing, packaging, marketing, advertising, promotions, merchandising, distribution and sales of the Goods that may be applicable in any given part of the Territory.
3.2 The Distributor shall not actively sell or market the Goods to customers having their place of business outside the Territory. The Distributor shall refrain from knowingly selling the Goods in the Territory to customers that intend to resell the Goods outside the Territory. The Distributor, however, shall be obligated to observe the terms of this Section only to the extent allowed under mandatory legislation.
Distributor’s Representations and Warranties
4.1 The Distributor represents and warrants that:
1) it is entitled to conclude the Agreement and that its contractual obligations do not infringe any rights of third parties.
2) it conforms to all applicable mandatory regulations and specifications in particular those relating to health, environment and work safety.
3) it has a liability insurance covering sufficiently XXX’s potential liability towards third parties resulting from reasons attributable to the Distributor. The Distributor shall deliver at request terms and conditions of the insurance and the insurance certificate.
4) the facilities used for the storage of the Goods conform to the requirements of the legal regulations and specifications and always have such qualities and properties that ensure safe and proper storage of the Goods. The storage and transport facilities as well as vehicles are appropriate for storage and transportation of food products (in terms of, among others, hygiene, humidity, temperature and absence of odour).
5) the representations and warranties set forth in this Section 4 are true and correct. If the Distributor becomes aware that they are untrue, misleading, or incorrect, it shall immediately notify the Customer of the same in writing.
Duration and Termination
14.1 This Agreement will enter into force after both parties have duly signed it and it will be valid after that until 31 December 2012. Unless the Agreement is terminated in writing at the latest three (3) months prior the expiry of the initial period, it shall continue to remain in force after the initial period indefinitely subject to termination by either party to end in writing observing a notice period of six (6) months.
14.2 In addition to the other terms of the distribution agreement (including these Standard Terms), a party has always the right to terminate the distribution agreement with an immediate effect if (i) the other party is in breach or default of any significant term or condition of the distribution agreement and fails to cure such breach or default (if curable) within thirty (30) days upon receipt of written notice from the other party asserting the breach or default; (ii) the other party becomes insolvent; or (iii) any such change would appear in the laws, rules, regulations, ordinances or practices regarding the manufacture, marketing, sales, export or import of the Goods that would materially affect XXX’s commercial possibilities to continue cooperation.
14.3 Both Parties may always terminate the distribution agreement in writing observing a notice period of six (6) months unless this right is specifically and expressly removed in the distribution agreement.
14.4 XXX may always terminate the distribution agreement with an immediate effect if the Distributor is in breach of its obligations relating to XXX’s Trademarks or other intellectual property rights or marketing or the Distributor has acted in a manner that has objectively caused harm to XXX, its reputation or its Trademarks or other intellectual property rights.
Governing Law and Dispute Resolution
21.1 The Agreement shall be governed by and construed in accordance with the laws of Finland. The parties seek to resolve any disputes in amicable negotiations. If the negotiations do not lead to settlement, any dispute, controversy or claim arising out of or in connection with the distribution agreement shall be finally settled by arbitration in accordance with the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules. The arbitration shall be held in Brussels in English language.

VERTRIEBSVEREINBARUNG
Umfang dieser Vereinbarung und Auftrag
2.1 Diese Vereinbarung umfasst neben diesem Dokument die in Abschnitt 25 angegebenen Anhänge (im Nachfolgenden zusammen als "Vereinbarung" bezeichnet).
2.2 Der Vertriebshändler erhält das ausschließliche Recht, die in Anhang 1 aufgeführten und von XXX hergestellten Produkte (nachfolgend als "Waren" bezeichnet) im Vertragsgebiet von Deutschland und den deutschen Handelsgruppen außerhalb von Deutschland zu vermarkten, zu verkaufen und zu vertreiben, vorausgesetzt dass XXX vorher sein schriftliches Einverständnis bezüglich der Länder außerhalb von Deutschland (im Nachfolgenden als "Vertragsgebiet" bezeichnet) gegeben hat. Ungeachtet des Vorstehenden hat der Vertriebshändler nicht das Recht, Waren in Finnland, Schweden, Norwegen, Dänemark, den baltischen Staaten und/oder Russland zu verkaufen oder zu vertreiben. Alle anderen Märkte sind entweder für XXX oder andere von XXX beauftragte Vertriebshändler reserviert.
2.3 Die Waren werden unter dem YYY-Warenzeichen oder allen anderen von XXX in schriftlicher Form genehmigten Warenzeichen oder Handelsmarken vermarktet, verkauft und vertrieben. Der Eindeutigkeit halber wird hiermit festgelegt, dass XXX dem Vertriebshändler keine Lizenz für die Verwendung irgendeines Warenzeichens von XXX erteilt. Die Parteien werden weder auf direkte noch auf indirekte Weise den Namen, das Warenzeichen oder andere ausschließliche Rechte auf der Verpackung als Teil ihres Firmennamens, Handelsnamens oder auf andere Weise verwenden.
Allgemeine Verpflichtungen des Vertriebshändlers
3.1 Der Vertriebshändler verpflichtet sich zur Einhaltung aller behördlichen Gesetze, Regelungen und Verordnungen, die in jedem Teil des Vertragsgebiets anwendbar sind, unter anderem bezüglich der Verarbeitung, Verpackung, Marketing, Werbung, Promotion, Merchandising, Vertrieb und Verkauf der Waren.
3.2 Der Vertriebshändler wird die Waren an Kunden, deren Geschäftssitz sich außerhalb des Vertragsgebiets befindet, weder aktiv verkaufen noch vermarkten. Der Vertriebshändler wird den wissentlichen Verkauf der Waren an Kunden im Vertragsgebiet unterlassen, welche die Absicht haben die Waren außerhalb des Vertragsgebiets weiterzuverkaufen. Der Vertriebshändler ist jedoch verpflichtet, die Bestimmungen dieses Abschnitts nur in dem vom Gesetzgeber zwingend vorgeschriebenen Ausmaß einzuhalten.
Zusicherungen und Gewährleistungen des Vertriebshändlers
4.1 Der Vertriebshändler sichert zu und gewährt folgendes:
1) Er ist zu dieser Vertragsschließung berechtigt. Rechte dritter Parteien werden durch seine vertraglichen Verpflichtungen nicht verletzt.
2) Er befolgt alle anwendbaren und zwingend vorgeschriebenen Verordnungen sowie Vorschriften, im Besonderen jene der Gesundheit, Umweltschutz und Arbeitssicherheit.
3) Er hat eine Haftpflichtversicherung abgeschlossen, die in ausreichendem Maße eine mögliche Haftung von XXX gegenüber dritten Parteien abdeckt, welche aus auf den Vertriebshändler zurückzuführenden Gründen entsteht. Der Vertriebshändler wird auf Anfrage die Versicherungsbedingungen sowie das Versicherungszertifikat vorlegen.
4) Die für die Lagerung der Waren verwendeten Anlagen entsprechen den Anforderungen der rechtlichen Vorschriften und Spezifikationen und weisen entsprechende Qualitäten und Eigenschaften auf, so dass eine sichere und angemessene Lagerung der Waren gewährleistet ist. Die Lagerungseinrichtungen und Transportmöglichkeiten sind für Lagerung und Transport von Nahrungsmitteln geeignet (unter anderem hinsichtlich Hygiene, Luftfeuchtigkeit, Temperatur und Geruchsneutralität).
5) Die in diesem Abschnitt 4 festgelegten Zusicherungen und Gewährleistungen sind wahr und korrekt. Sollte der Vertriebshändler Kenntnis davon erlangen, dass sie unwahr, irreführend oder nicht korrekt sind, wird er den Kunden umgehend über diesen Sachverhalt in schriftlicher Form benachrichtigen.
Dauer und Kündigung
14.1 Diese Vereinbarung tritt nach ihrer ordnungsgemäßen Unterzeichnung durch die beiden Parteien in Kraft und bleibt bis zum 31. Dezember 2012 gültig. Solange die Vereinbarung nicht mit einer Kündigungsfrist von mindestens drei (3) Monaten vor Ablauf des anfänglichen Zeitraums zum 31. Dezember 2012 in schriftlicher Form gekündigt wird, bleibt sie auch nach Ablauf des anfänglichen Zeitraums auf unbestimmte Zeit in Kraft und kann von jeder Partei unter Einhaltung einer Kündigungsfrist von sechs (6) Monaten in schriftlicher Form gekündigt werden.
14.2 Zusätzlich zu den anderen Bedingungen dieser Vertriebsvereinbarung (einschließlich dieser allgemeinen Bedingungen) hat jede Partei zu jedem Zeitpunkt das Recht, diese Vereinbarung fristlos zu kündigen, falls (i) eine Verletzung oder Nichteinhaltung einer beliebigen wichtigen Bestimmung dieser Vertriebsvereinbarung durch die andere Partei verschuldet wurde und diese Partei außerstande ist, eine solche Verletzung oder Nichteinhaltung innerhalb von dreißig (30) Tagen nach Erhalt einer schriftlichen Mitteilung der anderen Partei, welche die Verletzung oder Nichteinhaltung feststellt, zu beheben (falls es behoben werden kann); (ii) die andere Partei zahlungsunfähig wird; oder (iii) die Gesetze, Regelungen, Verordnungen, Bestimmungen oder Praktiken bezüglich Herstellung, Marketing, Verkauf, Export oder Import der Waren solcherart geändert werden würden, dass die Geschäftsmöglichkeiten von XXX hinsichtlich einer weiteren Zusammenarbeit schwerwiegend beeinträchtigt wären.
14.3 Beide Parteien können die Vertriebsvereinbarung jederzeit in schriftlicher Form unter Beachtung der Kündigungsfrist von sechs (6) Monaten kündigen, ausgenommen, dass dieses Recht speziell und ausdrücklich aus der Vertriebsvereinbarung herausgenommen wurde.
14.4 XXX kann die Vertriebsvereinbarung jederzeit fristlos kündigen, falls der Vertriebshändler seine Verpflichtungen bezüglich der Warenzeichen oder anderes geistiges Eigentum oder Marketing von XXX verletzt oder falls der Vertriebshändler aufgrund seiner Handlungen XXX, seinem Ruf, seinen Warenzeichen oder anderem geistigen Eigentum auf objektive Weise Schaden zugefügt hat.
Anwendbares Recht und Streitbeilegung
21.1 Die Vereinbarung unterliegt finnischem Recht und wird nach finnischer Rechtsprechung ausgelegt. Die Parteien bemühen sich alle Streitigkeiten in gütlichen Verhandlungen beizulegen. Falls die Verhandlungen nicht zur Beilegung führen, werden alle aus oder in Verbindung mit dieser Vereinbarung entstehenden Streitigkeiten, Kontroversen oder Ansprüche auf endgültige Weise durch das Schiedsgericht gemäß der Schiedsgerichtsordnung der Internationalen Handelskammer durch einen oder mehrere Schiedsrichter beigelegt, die in Übereinstimmung mit besagter Ordnung ernannt wurden. Das Schiedsgerichtsverfahren wird in Brüssel in englischer Sprache abgehalten.

Whereas, the PACKAGER is willing to provide an Operation, under the terms and conditions contained herein, for the Contract Packaging (as defined hereafter) of Service Parts (as defined hereafter) of XXX and Affiliated Companies, and

Article 1: Definitions
For all purposes of this Agreement, the following terms shall have the meaning herein specified unless the context otherwise specifies or requires. The definitions are equally applicable to both the singular and plural forms.
1.1. Integral Core Definitions
1.1.1. “Affiliated Companies” shall mean XXX and any company in which XXX owns, directly or indirectly, twenty-five percent or more of the capital or voting stock.
1.1.6 “Confidential Information” shall mean information in permanent form labeled by the provider as confidential and information transmitted orally which is stated at the time that it is provided to be confidential and then as soon as practicable afterwards, reduced to permanent form by the provider and sent to the other labeled confidential. Any technical information and data furnished by XXX as well as any information relating to any portion of XXX´s business shall qualify as Confidential Information, irrespective of its form and labeling. Even though material supplied by one Party to the other may be described as confidential, it will not qualify as Confidential Information or will cease to qualify as such if the material: (a) is already known to the Party receiving it, unless prior knowledge was obtained subject to a similar and still subsisting duty of confidentiality; or (b) becomes known later to the Party receiving it, unless the later knowledge is obtained either unlawfully or subject to a similar duty of confidentiality; or (c) is or finds its way into the public domain other than by breach of any agreement by the receiving Party.
1.2. Premises and Operational Point Definitions
1.2.1 "Operation" shall mean the facility located as specified in Attachment 2 which has been identified by the PACKAGER and agreed by XXX.
1.2.2. “Contract Packaging” (CP) shall mean a location and service contracted by XXX to pack Service Parts and to procure Packaging Material in line with the Packaging Material Specification (PMS).
1.3. Transport Logistics Definitions
1.3.1. "Transport" shall mean all transportation to and from the Warehouse or other delivery points as agreed between the Parties, documentation and the clearance of documentation as required by all applicable customs and legal authorities.
1.3.5. "Container" or "Handling Unit" shall mean a durable shipping or storage unit which is collapsible or can be dismantled, such as a pallet, a Roller Container (RC), a C-box, a plastic box or a UZE-39. Durable Containers are XXX's property.
1.4. Customer and Supplier Definitions
1.4.1. "Dealers" shall mean XXX authorised dealers, repairers or parts distributors appointed by XXX or XXX Affiliated Companies, as well as those independent purchasers of Service Parts as may be designated in writing by XXX from time to time.
1.5. Commodity Definitions
1.5.1. "Service Parts" shall mean parts and accessories stocked by XXX and XXX Affiliated Companies to be sent to Dealers in order to service XXX branded vehicles as well as other vehicles. Service Parts shall include, but shall not be limited to, parts for "XXX" branded vehicles, "YYY" branded parts, "ZZZ" parts and other parts and accessories packaged and branded as specified by XXX and XXX Affiliated Companies.
3.3. Contract Packaging Services- Physical Handling
3.3.1. (a) Dangerous Substances shall be defined in the XXX operations manual; such definition shall comply with the local laws and regulations. XXX shall have a duty to inform the PACKAGER in advance of the arrival of the Service Parts which are classified as Dangerous Goods. Unless so informed, the PACKAGER shall regard the Service Parts as non-Dangerous Goods.
3.5. Contract Packaging Services - Reporting
3.5.3. The PACKAGER shall submit a monthly total ageing metric report, including graphs by the seventh (7th) working day of the following month to XXX.
Article 4: Distribution of Service Parts
4.1. The Shipping of Service Parts by the PACKAGER from the Operation to depots shall be on a daily basis (from Monday to Friday between 6:00 and 18:00 local time), except for legal holidays. The Service Parts to be shipped within the times set in Attachment 4.
Article 10: Liability
10.1. (a) The PACKAGER shall be liable for any loss or damage to the Service Parts during the period from receipt of the Service Parts at the Warehouse until handover of material to be shipped for further transport, and for any damage caused by the PACKAGER occurring during transport until arrival of the Service Parts at the PDC.
Article 11: Confidentiality
11.1 XXX and the PACKAGER and their respective employees shall not disclose Confidential Information from and/or regarding the other Party, except as necessary to supply relevant information to a subcontractor, an authority, an insurance company or a third party in support of this Agreement, and only then with the prior consent of the other Party and after providing reasonable assurances that such third party will maintain the information in confidence.
Article 17: Severability
17.1 If it should be found that any term or condition of this Agreement which is essential to the proper and effective operation of this Agreement violates any law or regulation of any authority having jurisdiction over the subject matter of this Agreement, and that term or provision is accordingly of no force of effect, both Parties hereto shall consult with each other in good faith to agree upon a remedial action with a view to continuing and maintaining this Agreement.
Article 18: Assignment; Set-off
18.1 This Agreement is personal to XXX and the PACKAGER and may not be assigned or otherwise transferred by either Party, including a change of subcontractors, in whole or in part without the prior consent in writing of the other and any attempted assignment of this Agreement or any part thereof without such consent, whether by voluntary act or by operation of law, shall be null and void; provided, however, that XXX, without the consent of the PACKAGER, may assign this Agreement to any Affiliated Company.
18.2 The PACKAGER shall have no right to assign, in whole or in part, to third parties, its credits towards XXX or to offset its credits against credits of XXX.
IN WITNESS WHEREOF, the Parties hereto have executed this Agreement as of the date first above written.

Artikel 1: Definitionen
Für alle Zwecke dieser Vereinbarung haben die folgenden Definitionen die hierin angegebene Bedeutung, es sei denn, der Kontext erfordert oder gibt etwas anderes an. Die Definitionen gelten ebenso für Singular- wie auch für Pluralformen.
1.1. Wesentliche Kerndefinitionen
1.1.1. “Verbundene Unternehmen” bedeutet XXX sowie jedes Unternehmen, von welchem XXX, direkt oder indirekt, mindestens fünfundzwanzig Prozent des Kapitals oder der Stimmrechtsaktien besitzt.
1.1.6. “Vertrauliche Informationen” bedeutet Informationen in dauerhafter Form, die vom Anbieter als vertraulich gekennzeichnet sind sowie mündlich weitergegebene Informationen, welche zum Zeitpunkt der Weitergabe als vertraulich bezeichnet, anschließend sobald wie möglich durch den Anbieter auf eine dauerhafte Form gekürzt und zu den anderen vertraulichen Informationen gesendet werden. Alle technischen Informationen und Daten, die von XXX gegeben werden sowie alle Informationen, die zu irgendeinem Unternehmensbestandteil von XXX in Beziehung stehen, gelten als vertrauliche Informationen, ungeachtet ihrer Form oder Kennzeichnung. 1.2. Definition der Betriebsgebäude und Betriebspunkte
1.2.1. "Betrieb" ist die Einrichtung, die sich am in Anlage 2 angegebenen Ort befindet, welche vom VERPACKER festgelegt und von XXX genehmigt wurde.
1.2.2. “Auftragsverpackung” (CP / Contract Packaging) ist der von XXX unter Vertrag genommene Standort und Dienst zur Verpackung von Serviceteilen und Beschaffung von Verpackungsmaterial gemäß der Verpackungsmaterialspezifikation (PMS / Packaging Material Specification).
1.3. Definition der Transportlogistik
1.3.1. "Transport" bedeutet alle Transporte zum und aus dem Warenlager oder anderen von den Parteien vereinbarten Auslieferungspunkten sowie Dokumentationen und die Freigabe von Dokumentationen durch Zoll und Justizbehörden.
1.3.5. "Container" oder "Frachtumschlagseinheit" bedeutet eine haltbare Versand- oder Lagereinheit, welche zerlegbar ist oder demontiert werden kann, wie z. B. eine Palette, ein Rollcontainer (RC), eine C-Box, eine Plastikbox oder ein UZE-39. Haltbare Container sind das Eigentum von XXX.
1.4. Definition von Kunden und Lieferanten
1.4.1. "Händler" bedeutet die von XXX autorisierten Händler, Werkstätten und die von XXX oder seinen verbundenen Unternehmen ernannten Serviceteilhändler sowie diejenigen unabhängigen Händler, die bisweilen von XXX schriftlich dazu ernannt werden.
1.5. Definition der Ware
1.5.1. "Serviceteile" bedeutet Bauteile sowie Zubehör, das von XXX und seinen verbundenen Unternehmen gelagert und zu den Händlern geschickt wird, um Fahrzeuge der Marke XXX sowie andere Fahrzeuge zu warten. Serviceteile beinhalten, ohne darauf beschränkt zu sein, Bauteile für Fahrzeuge der Marke "XXX", Bauteile der Marke "YYY", "ZZZ" -Bauteile sowie andere verpackte und mit Marken versehene Bauteile, wie von XXX und seinen verbundenen Unternehmen angegeben.
3.3. Dienstleistungen der Auftragsverpackung – Physische Abwicklung
3.3.1. (a) Gefährliche Substanzen werden im XXX-Betriebshandbuch definiert. Diese Definition richtet sich nach den örtlichen Gesetzen und Vorschriften. XXX hat die Pflicht den VERPACKER über die Ankunft derjenigen Serviceteile im Voraus zu informieren, die als Gefahrengüter klassifiziert sind. Solange der VERPACKER diesbezüglich nicht informiert wurde, sind die Serviceteile nicht als Gefahrengüter anzusehen.
3.5. Dienstleistungen der Auftragsverpackung - Berichterstattung
3.5.3. Der VERPACKER reicht am siebten (7.) Arbeitstag des darauffolgenden Monats einen monatlichen Statistikbericht über die gesamten ausstehenden Lieferungen einschließlich Diagrammen bei XXX ein.
Artikel 4: Vertrieb der Serviceteile
4.1. Der vom VERPACKER durchgeführte Versand der Serviceteile vom Betrieb an die Lager erfolgt täglich (von Montag bis Freitag zwischen 6:00 und 18:00 Ortszeit), ausgenommen sind gesetzliche Feiertage. Die Serviceteile müssen innerhalb der in Anlage 4 festgelegten Zeiten versendet werden.
Artikel 10: Haftung
10.1. (a) Der VERPACKER haftet für jeglichen Verlust oder Schaden der Serviceteile, während des Zeitraums vom Empfang der Serviceteile im Warenlager bis zur Übergabe des zu versendenden Materials für den weiteren Transport sowie für jeglichen durch den VERPACKER verursachten Schaden, der während des Transports bis zur Ankunft der Serviceteile im PDC auftritt.
Artikel 11: Vertraulichkeit
11.2 XXX und der VERPACKER sowie deren jeweilige Mitarbeiter werden keine vertraulichen Informationen von und/oder bezüglich der anderen Partei preisgeben, es sei denn, dass es zur Erfüllung dieses Vertrags notwendig ist, wichtige Informationen an einen Subunternehmer, Behörde, Versicherung oder dritten Partei weiterzugeben. Dies erfolgt dann auch nur mit vorheriger Zustimmung der anderen Partei und nachdem ausreichende Sicherheitsmaßnahmen getroffen wurden, dass die betreffende dritte Partei Stillschweigen über die Informationen bewahren wird.
Artikel 17: Salvatorische Klausel
17.1 Sollte sich herausstellen, dass eine beliebige Bedingung dieses Vertrags, welche für die ordnungsgemäße und reibungslose Durchführung dieses Vertrags unerlässlich ist, gegen irgendein Gesetz oder Vorschrift irgendeiner Behörde verstößt, die für den Gegenstand dieses Vertrags zuständig ist, und diese Bedingung dementsprechend nicht in Kraft treten kann, werden sich beide Parteien in Treu und Glauben über eine Abhilfemaßnahme zwecks Fortführung und Erhalt dieses Vertrags einigen.
Artikel 18: Abtretung; Aufrechnung
18.1. Dieser Vertrag gilt nur für XXX und den VERPACKER und kann durch keine der beiden Parteien vollständig oder teilweise abgetreten oder auf andere Weise übertragen werden, einschließlich einem Wechsel von Subunternehmern, ohne vorherige schriftliche Zustimmung der anderen Partei. Jeder Versuch einer Abtretung dieses Vertrags oder irgendeines Teils davon ohne eine solche Zustimmung, ob durch einen willkürlichen Akt oder kraft Gesetzes, ist null und nichtig. Es ist jedoch vorgesehen, dass XXX diesen Vertrag ohne Zustimmung des VERPACKERS an ein beliebiges verbundenes Unternehmen abtreten kann.
18.2. Der VERPACKER hat kein Recht seine Guthaben gegenüber XXX an dritte Parteien vollständig oder teilweise abzutreten oder seine Guthaben gegen Guthaben von XXX aufzurechnen.
ZU URKUND DESSEN haben die beteiligten Parteien diesen Vertrag ab dem ersten oben angegebenen Datum unterzeichnet.

America's state secrets and constitutional rights
President George W. Bush's excesses in the name of fighting terrorism are legion. To avoid accountability, his administration has repeatedly sought early dismissal of lawsuits that might finally expose government misconduct, brandishing flimsy claims that going forward would put national security secrets at risk.
The courts have been far too willing to go along. In cases involving serious allegations of kidnapping, torture and unlawful domestic eavesdropping, judges have blocked plaintiffs from pursuing their claims without taking a hard look at the government's basis for invoking the so-called state secrets privilege: Its insistence that revealing certain documents or other evidence would endanger the nation's security.
As a result, victims of serious abuse have been denied justice, fundamental rights have been violated and the constitutional system of checks and balances has been grievously undermined. Congress may now be ready to push back. The House and Senate are developing legislation that would give victims fair access to the courts and make it harder for the government to hide illegal conduct behind such unsupported claims.
Senator Edward Kennedy, the Massachusetts Democrat, and Arlen Specter, a Pennsylvania Republican, have jointly introduced the State Secrets Protection Act. The measure would require judges to examine the actual documents or other evidence for which the state secrets privilege is invoked, rather than relying on government affidavits asserting that the evidence is too sensitive to be publicly disclosed. Representative Jerrold Nadler, Democrat of New York, expects to introduce a similar measure in the House.

Präsident George W. Bush hat im Namen der Terrorismusbekämpfung unzählig viele Exzesse begangen. Um sich der Verantwortung zu entziehen, hat seine Regierung durch das Vorbringen fadenscheiniger Behauptungen, dass ein weiteres Vorgehen die Geheimnisse der nationalen Sicherheit aufs Spiel setzen würde, wiederholt versucht, eine vorzeitige Abweisung von Klagen zu erreichen, die letztendlich ein Fehlverhalten seitens der Regierung aufdecken könnten.
Die Gerichte sind bislang nur zu bereitwillig gewesen, das Spiel mitzumachen. In Fällen schwerwiegender Anschuldigungen bezüglich Entführungen, Folter und rechtswidrigen Abhörens zuhause haben Richter Kläger davon abgehalten ihre Rechte weiterhin durchzusetzen ohne einen kritischen Blick auf die Grundlage der Regierung zu werfen, sich auf das sogenannte Privileg für Staatsgeheimnisse zu berufen: Das Beharren seitens der Regierung darauf, dass die Offenlegung bestimmter Dokumente oder anderer Beweismittel die Sicherheit der Nation gefährden würde.
Als Folge davon wurde Opfern schweren Rechtsmissbrauchs die Gerechtigkeit verweigert, gegen Grundrechte verstoßen sowie das verfassungsrechtlich verankerte System der "checks and balances" (Prinzip der gegenseitigen Kontrolle und des Machtgleichgewichts von Regierungsgewalten) auf schwerwiegende Weise untergraben.
Der Kongress ist jetzt vielleicht dazu bereit, Gegenmaßnahmen einzuleiten. Repräsentanten und Senat entwickeln gerade Gesetze, die Opfern einen berechtigten Zugang zu Gerichten ermöglichen und es der Regierung erschweren würden, rechtswidriges Verhalten hinter solchen unbegründeten Behauptungen zu verbergen.
