21. Door de verdediging is gesteld dat in gewapende conflicten, om het even of het om een internationaal of intern conflict gaat, het ius in bello steeds als een lex specialis ten opzichte van het commune strafrecht heeft te gelden (p. 22 pleitnotities). Dit standpunt kan ik niet volgen. De verhouding tussen commuun strafrecht en oorlogsrecht (ongeacht of het om internationale dan wel interne conflicten gaat) is deze, dat oorlogshandelingen die een delictsomschrijving vervullen (bijvoorbeeld art. 289 Sr of 303 Sr) indien door militairen begaan tegen de vijand, gerechtvaardigd zijn, tenzij daarbij het oorlogsrecht wordt geschonden. Dat laatste is bijvoorbeeld het geval bij gericht schieten op burgers. The defence argued that in armed conflicts, whether international or internal, ius in bello, or the conduct of belligerents during a war, still applies as a lex specialis with respect to general criminal law (p. 22 pleading). I cannot follow this position. The relationship between general criminal law and the laws of war (no matter whether an international or internal conflict) is that acts of war that fit a description of the offence (for instance, Article 289 of the Criminal Code or 303 of the Criminal Code), if carried out by soldiers against the enemy, are legitimate unless in so doing they violate the laws of war. The latter would be the case with intentional shooting of civilians. This relationship is set forth for The Netherlands in Article 38 of the Military Penal Code (11), but would hold true even without that Article. |
