Source text - English The procedure before a labor inspector is merely conciliatory, but if the inspector identifies a straight violation of labor law (which is public policy), he/she will order the law to be abided by, as in the case of an employer having withheld from salary against the terms of Article 59 CLC as explained below. This will provide the employee with better grounding to sue before a labor judge in the event that the employer does not comply, whereat the claim would be not only for the unpaid worth of salary but also for the following expensive concept: CLC "Article 65.- Indemnification for default in payment: If at termination of the contract, the employer does not pay the worker the salaries or benefits due, save for cases of withholding authorized by the law or convened by the parties, [the employer] must pay the worker, as indemnification, a sum equal to the last daily salary for each day of default up to twenty four (24) months, or until the payment is made if so in less time. If twenty four (24) months elapse counted as from the date of contract termination, (...), the employer shall pay the worker default interest at the maximum rate for commercial credit certified by XXX, as from the initiation of the twenty fifth (25) month until the payment is made." Thus, the employee would be entitled to a full day's worth of salary until the amount thought or known to be stolen by that same employee is reimbursed to him/her. This is a high cost.
