Source text - Spanish Sector Sanitario HOSPITALES Business Plan DESCRIPCION BREVE DE LA SITUACION Después de un año de aproximación a este sector y habiendo logrado, un relativo éxito en lo que se refiere a la posición de la solución alcohólica, podemos indicar a grandes rasgos las siguientes conclusiones: 1) El sector tiene graves carencias en la definición de fórmulas eficaces, tomando soluciones individuales en función del criterio único de los responsables implicados. 2) La reducción de infecciones nosocomiales pasa por definirse como un aspecto estratégico, dentro del ámbito de las iniciativas consideradas por los responsables de cada uno de los hospitales, no teniendo conexión directa con las acciones a tomar. 3) La mayoría de los hospitales tienen definidos protocolos para la higiene de la piel, para evitar así el contagio y, o, transmisión de enfermedades entre pacientes y trabajadores , aunque resulta realmente difícil encontrar un solo hospital en el que los medios disponibles permitan el cumplimiento de dicho protocolo. 4) En la sanidad pública, el criterio de compras se apoya en concursos públicos estableciendo como referencia el precio por litro de los productos ofertados, aspectos como la ergonomía, calidad, grado de satisfacción costes por uso, no son tenidos en consideración, lo que dificulta y en algunos casos prácticamente imposibilita, incluso el acceder al concurso. 5) Considerar también que las competencias de sanidad están transferidas en muchos casos a las diferentes comunidades autónomas, generando así más diferencias, en función de los recursos económicos disponibles. Those which make the tender difficult and, in some cases, make it impossible to access to it, are not taken into consideration. 5) We should also consider that health competencies are, in many cases, transferred to the different autonomous communities, thus generating more differences regarding the available economic resources. We can therefore conclude that, working through the differentiating aspects, this sector offers the possibility of achieving an approximation position based on dosage systems, and thus defining the health section as a medium-term growth opportunity.

Que el articulo 31 de las normas sobre Aspectos Relacionados a1 Comercio de la Propiedad Intelectual (ADPIC) de la Organización Mundial de Comercio, reconoce el derecho de los paises a emitir licencias obligatorias para patentes de medicamentos que sirvan para combatir y mitigar enfermedades de interés público; Que la declaración de Doha sobre los acuerdos de ADPIC y la Salud Pública, adoptado unánimemente por los Estados Miembros de la Organización Mundial de Comercio, especifica que cada Estado Miembro "tiene el derecho de conceder licencias obligatorias y la libertad de determinar las bases sobre las cuales se conceden tales licencias". Doha’s declaration about TRAIP and Public Health agreements, adopted unanimously by the Member States of the World Trade Organization, states that each Member State “is entitled to issue compulsory licenses and is free to determine the bases on which such licenses are granted”. Furthermore, such declaration points out that the TRAIP Agreement should be interpreted and applied in order to “promote the access to the medicines for all”. Ha entregado la manifestación a que se refiere el artículo 29 fracción VIII de la Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público. 2.8. Reconoce plenamente la personalidad con que interviene el representante de (PEMEX U ORGANISMO SUBSIDIARIO). 2.9. Reconoce y acepta que cuenta con los elementos propios a que se refiere el artículo 13 de la Ley Federal del Trabajo y en consecuencia es el único patrón de todas y cada una de las personas que intervengan en el desarrollo y ejecución del objeto de este contrato. 2.10 Su moneda funcional es _________. TRATÁNDOSE DE CONTRATOS CUYO MONTO EXCEDA EL IMPORTE DE $300,000 SIN INCLUIR EL I.V.A. De manera previa a la formalización del presente contrato y para los efectos del articulo 32-D del Código Fiscal de la Federación, ha presentado a (PEMEX U ORGANISMO SUBSIDIARIO) el "acuse de recepción" con el que comprueba que ha realizado la solicitud de opinión respecto de sus obligaciones ante el Sistema de Administración Tributaria prevista en la Resolución Miscelánea Fiscal vigente. 2.14. TRATÁNDOSE DE UN PROVEEDOR RESIDENTE EN EL EXTRANJERO QUE NO CUENTE CON ESTABLECIMIENTO PERMANENTE EN EL PAÍS. No tiene establecimiento permanente en el país y que, durante la ejecución de este contrato no tiene la intención de crearlo. Para los efectos del artículo 32-D del Código Fiscal de la Federación ha presentado a (PEMEX U ORGANISMO SUBSIDIARIO) el escrito de manifestación de no encontrarse obligado a presentar los requisitos establecidos en la Resolución Miscelánea Fiscal vigente. 2.15. TRATÁNDOSE DE PERSONAS MORALES O FÍSICAS Y QUE LA CONTRATACIÓN RESULTE DE UNO DE LOS PROCEDIMIENTOS DE CONTRATACIÓN DE CARÁCTER NACIONAL FUNDADOS EN EL ARTÍCULO 26 FRACCIÓN I Y II Y 28 FRACCIÓN I DE LA LEY DE ADQUISICIONES, ARRENDAMIENTOS Y SERVICIOS DEL SECTOR PÚBLICO. Ha presentado ante la (nombre del área de contratación), la documentación correspondiente con la cual acredita su nacionalidad mexicana así como la que demuestra tener su domicilio en territorio nacional, en términos de la Regla Octava del “Acuerdo por el que se establecen las Reglas para la Determinación y Acreditamiento del Grado de Contenido Nacional tratándose de Procedimientos de Contratación de Carácter Nacional” publicado en el Diario Oficial de la Federación del 3 de marzo del 2000. 2.16 TRATÁNDOSE DE CONTRATOS ADJUDICADOS CON FUNDAMENTO EN EL ARTÍCULO 42 DE LA LEY DE ADQUISICIONES, ARRENDAMIENTOS Y SERVICIOS DEL SECTOR PÚBLICO. El PROVEEDOR declara que su empresa se encuentra ubicada en la siguiente estratificación (Tamaño, Sector y Clasificación) de acuerdo con la Ley para el Desarrollo de la Competitividad de la Micro, Pequeña y Mediana Empresa. 2.17. TRATÁNDOSE DE UNA PROPOSICIÓN CONJUNTA. Con base en lo dispuesto en el artículo 34 de la Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público, presentaron una proposición conjunta y con fundamento en el artículo 31 del Reglamento de la Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público, celebraron un convenio privado de proposición conjunta de fecha __________________, mismo que forma parte integrante de este contrato como anexo “[señalar número de anexo]”, por el cual se obligan de manera solidaria a [entregar los bienes/prestar los servicios] en términos del presente contrato. SEGUNDA.- VIGENCIA DEL CONTRATO La vigencia de este contrato iniciará en la fecha de firma del mismo y concluirá el ____. La(s) referencia(s) (MXP, USD o DLS E.U.A., CAD, GBP, etc.) asentada(s) en la columna precio unitario del anexo ___ de este contrato significan (Pesos Mexicanos, Dólares de los Estados Unidos de América, Dólares Canadienses, Libra Esterlina, etc.) QUINTA.- CONDICIONES Y FORMA DE PAGO (PEMEX U ORGANISMO SUBSIDIARIO) pagará al PROVEEDOR el monto de los servicios concluidos y aceptados de acuerdo con las condiciones establecidas en este contrato a los (número) (letra) días naturales (máximo 20 días naturales) contados a partir de la fecha de recepción y aceptación del original de la factura, acompañada de la documentación soporte que proceda y del acuse de recibo correspondiente conteniendo: el sello del área receptora de los servicios, fecha de la recepción, así como el nombre, ficha y firma del personal facultado para estos efectos. De conformidad con las disposiciones normativas en materia de pago de la Dirección Corporativa de Finanzas de Petróleos Mexicanos cuando la fecha de vencimiento sea día inhábil bancario en la plaza de pago se aplicará el siguiente criterio: VENCIMIENTO INHÁBIL PAGO Domingo Día hábil posterior Sábado Día hábil anterior Lunes a jueves Día hábil posterior Viernes Día hábil anterior CUANDO APLIQUE En el caso particular del jueves y viernes de Semana Santa, el pago se efectuará el día hábil siguiente. El pago al PROVEEDOR se efectuará a través de depósito bancario en la cuenta que para tal efecto designe el mismo en el momento de darse de alta en la Ventanilla Única de (PEMEX U ORGANISMO SUBSIDIARIO). Una vez realizado el pago al PROVEEDOR, éste tendrá diez (10) días hábiles para solicitar aclaraciones sobre cualquier aspecto del mismo; transcurrido dicho plazo sin que se presente reclamación alguna, éste se considerará definitivamente aceptado y sin derecho a ulterior reclamación. Los pagos que al respecto procedan, se realizarán de acuerdo a lo dispuesto en esta cláusula y estarán sujetos a lo establecido en el segundo y tercer párrafo del artículo 51 de la Ley de Adquisiciones, Arrendamientos y Servicios del Sector Público para el caso de atraso en los pagos y pagos en exceso que se realicen. El PROVEEDOR, siempre y cuando no tenga adeudos vencidos y los servicios hayan sido prestados conforme a lo especificado en este contrato, podrá solicitar la condición de pronto pago cuando acepte el porcentaje de descuento que resulte de aplicar la Tasa de Interés Interbancaria de Equilibrio (TIIE) de 28 días, más cuatro puntos porcentuales, que se encuentre vigente con dos días hábiles previos a la fecha valor en que se presente la solicitud de “Pronto Pago”. En caso de que dejara de publicarse la tasa TIIE, se utilizará la que determine el Banco de México en sustitución de ésta. En todos los casos, el porcentaje obtenido se deberá multiplicar por el número de días por los que el PROVEEDOR solicite el adelanto del pago. Para tal efecto, deberá presentar la solicitud correspondiente en los términos establecidos por la Dirección Corporativa de Finanzas, por lo menos, con tres (3) días hábiles de anticipación a la fecha en que deba efectuarse el pago en forma adelantada, misma que deberá contener la siguiente leyenda “Bajo protesta de decir verdad, manifiesto que los documentos que se presentan para pronto pago objeto de esta solicitud, no se encuentran en trámite de descuento para financiamiento ante ninguna institución financiera que implique que el pago se encuentra comprometido o cedido a un tercero”, y presentar Nota de Crédito a favor de (PEMEX U ORGANISMO SUBSIDIARIO) bajo el concepto de “descuento por pronto pago” misma que deberá reunir los requisitos fiscales establecidos en los arts. 29 y 29-A del Código Fiscal de la Federación. El pago estará sujeto a la disponibilidad presupuestal en flujo de efectivo en (PEMEX U ORGANISMO SUBSIDIARIO). TRATÁNDOSE DE COMPROMISOS PAGADEROS EN DÓLARES DE LOS ESTADOS UNIDOS DE AMÉRICA, DEBERÁ AGREGARSE EL SIGUIENTE PÁRRAFO: Para los compromisos en dólares de los Estados Unidos de América, el porcentaje será el que resulte de aplicar la Tasa Prime Rate publicada en medios electrónicos financieros, que se encuentre vigente con dos días hábiles de anticipación previos a la fecha valor en que se presente la solicitud de “Pronto Pago”. TRATÁNDOSE DE COMPROMISOS PAGADEROS EN EUROS, DEBERÁ AGREGARSE EL SIGUIENTE PÁRRAFO: Para los compromisos denominados en Euros, el porcentaje de descuento será el que resulte de aplicar la Tasa EURIBOR de un mes, multiplicada por 1.5, que se encuentre vigente con dos días hábiles de anticipación previos a la fecha valor en que se presente la solicitud de “Pronto Pago”. TRATÁNDOSE DE OBLIGACIONES DE PAGO EN MONEDA EXTRANJERA PAGADERAS EN TERRITORIO NACIONAL. Las obligaciones de pago denominadas en moneda extranjera para ser cumplidas en la República Mexicana, se solventarán en moneda nacional, al tipo de cambio vigente que publique el Banco de México en la fecha en que se haga dicho pago. EL SIGUIENTE PÁRRAFO SE ADICIONARÁ EN CASO DE QUE SE HAYA PRESENTADO UNA PROPOSICIÓN CONJUNTA, SIN QUE SE HAYA CONSTITUIDO UNA SOCIEDAD, O NUEVA SOCIEDAD EN CASO DE PERSONAS MORALES, O SI NO SE CELEBRA UN CONTRATO DE ASOCIACIÓN EN PARTICIPACIÓN.
