§ 1. Jeżeli nie umówiono się inaczej, z dniem zapłaty odszkodowania przez zakład ubezpieczeń roszczenie ubezpieczającego przeciwko osobie trzeciej odpowiedzialnej za szkodę przechodzi z mocy prawa na zakład ubezpieczeń do wysokości zapłaconego odszkodowania. Jeżeli zakład pokrył tylko część szkody, ubezpieczającemu przysługuje co do pozostałej części pierwszeństwo zaspokojenia przed roszczeniem zakładu ubezpieczeń.
§ 2. Nie przechodzą na zakład ubezpieczeń roszczenia ubezpieczającego przeciwko osobom, z którymi ubezpieczający pozostaje we wspólnym gospodarstwie domowym lub za które ponosi odpowiedzialność.

Indien niet anders overeengekomen, vanaf de dag dat door de verzekeraar een schadevergoeding wordt uitbetaald, gaan de vorderingen van de verzekeringnemer ten aanzien van een voor deze schade aansprakelijke derde van rechtswege op de verzekeraar over tot het bedrag van de uitbetaalde schadevergoeding. Indien de verzekeraar de schade slechts gedeeltelijk heeft vergoed, heeft de verzekeringnemer voor het resterende deel voorrang in zijn regres boven de vordering van de verzekeraar.
§ 2. De verzekeraar krijgt geen vorderingen van de verzekeringnemer ten aanzien van personen, met wie hij een gezamenlijk huishouden voert of voor wie hij verantwoordelijk is.
