EXPONEN
I.- Que Don XXX es titular del derecho de uso y disfrute de un puesto de atraque número XXX, sito en XXX de igual término municipal, con dimensiones de XXX (…); está dotado de argolla de amarre, cadena de amarre, cadena de fondeo y tomas de agua y luz. Con un período de concesión Administrativa de cincuenta años desde el inicio de la misma, es decir, desde XXX hasta XXX que finaliza.
Cargas y limitaciones.- Libre de cargas y gravámenes o arrendamientos.
Que le pertenece en virtud de escritura de cesión autorizada por el Notario de XXX, don XXX, en fecha XXX al número XXX de su Protocolo.

Each party recognising the other party's legal capacity to do so, they have agreed upon this assignment of option to purchase, as follows:
I.- Mr. XXX owns the legal and beneficial title to the landing stage XXX, measuring XXX metres and XXX centimetres (…), located in XXX in the municipality of XXX. The aforementioned landing stage disposes of a mooring ring, a mooring chain, an anchor chain, as well as water and electricity outlets. Administrative concession for the same has been granted for a period of fifty years, starting from XXX, until expiry.
Charges and limitations.- The property is free and clear of charges, encumbrances or tenancies.
Mr. XXX owns this property by virtue of the assignment deed issued by the Notary Public of XXX, Mr. XXX, on XXX (certificate number XXX).

XXX endeavours to ensure that, under normal working conditions, 80% of the pages delivered to the Client will be delivered under an average response time of 5 seconds. This includes the Internet connection of any users accessing the system, and is measured from when the request is made to when the page is delivered to either the users browser, or the user’s proxy server (if the user is in a corporate network). In this respect XXX sizes its hardware and telecommunications ports and related equipment such that this level of response time should be generally achieved to the level of service set forth in this Schedule.
This level of system response is very dependent on the Internet and third party telecommunications systems which are not within XXX’s control.
XXX therefore cannot guarantee such system response times but where the Client continually, or regularly, experiences a system response time in excess of this target XXX will investigate the problem and will endeavour to make changes to the Infrastructure or other telecommunications equipment or recommend alternative actions by the Client, to improve the system response times.
Average response times are reported to the Client in the quarterly service review meetings.
XXX delivers dedicated virtual servers and a dedicated database schema which are sized to manage the following volume requirements: (…)
If the Client exceeds these volume requirements, then additional users may be prevented from connecting to the Application, and the average response time will no longer apply.
Performance metrics are reviewed at the quarterly service meetings, and extra capacity can be ordered at this time if it is mutually agreed that this is required.

XXX wird angemessene Anstrengungen unternehmen, um sicherzustellen, dass die Response-Zeit für 80 % der vom Kunden unter normalen Arbeitsbedingungen aufgerufenen Seiten weniger als durchschnittlich 5 Sekunden beträgt. Dies gilt für die Internetverbindung aller auf das System zugreifenden Nutzer und wird gemessen ab dem Zeitpunkt der Anfrage bis zur Übermittlung der Seite entweder an den Browser des Nutzers oder dessen Proxyserver (wenn sich der Rechner in einem Unternehmensnetzwerk befindet). Durch eine entsprechende Auslegung von Hardware- und Telekommunikationsschnittstellen sowie aller zugehörigen Geräte seitens des Dienstleisters lassen sich diese vertraglich vereinbarten Response-Zeiten im Allgemeinen gewährleisten.
Gleichwohl hängt die Gewährleistung derart hoher Response-Zeiten in hohem Maße vom Internet und dritten Telekommunikationssystemen ab, auf die XXX keinerlei Einfluss hat.
Aus diesem Grund ist es XXX unmöglich, eine hundertprozentige Garantie für die vereinbarten Response-Zeiten zu gewährleisten. Sollten Response-Zeiten kontinuierlich oder auf regelmäßiger Basis über dem vertraglich vereinbarten Wert liegen, wird XXX das Problem untersuchen und angemessene Anstrengungen unternehmen, um die Infrastruktur oder andere Telekommunikationseinrichtungen zu modifizieren, bzw. dem Kunden alternative Vorgehensweisen empfehlen, um die Response-Zeiten des Systems zu verbessern.
Durchschnittliche Response-Zeiten werden dem Kunden in den vierteljährlich stattfindenden Review-Meetings vorgelegt. XXX bietet seinen Kunden spezielle virtuelle Server mit einer entsprechenden Datenbankarchitektur, die jeweils zur Erfüllung der folgenden Volumenanforderungen ausgelegt sind: (...)
Überschreitet der Kunde diese Volumenanforderungen, können zusätzliche Nutzer möglicherweise nicht auf die Anwendung zugreifen und die durchschnittlichen Response-Zeiten sind nicht länger gültig.
Performance-Metriken werden im Rahmen der vierteljährlichen Service-Meetings geprüft. Zu diesem Zeitpunkt können zusätzliche Kapazitäten bestellt werden, sofern beide Vertragspartner übereinkommen, dass diese Maßnahme erforderlich ist.
