Custodial Account Agreement
Introduction
Read this Agreement thoroughly before completing the Application. By signing the Application, you understand and agree to the terms and conditions of this Agreement and have executed an Application in order to establish a Health Savings Account (“HSA”) with the Custodian under Section 223, its sub-sections, and applicable rulings and provisions of the Code.
An HSA is an individually owned account maintained at a financial institution where tax-favored contributions can be made on behalf of individuals covered under certain High Deductible Health Plans (“HDHPs”) with tax-free distributions allowed for qualified medical expenses. Note: An individual establishing an HSA is not entitled to tax favored treatment unless certain federal requirements are met. These requirements are summarized in this Agreement. Your HSA funds will be maintained by the Custodian and will indicate which portion, if any, of your funds reside in an FDIC insured account. Your HSA funds will earn interest in accordance to your Custodian’s published rates.
An HSA is established pursuant to federal tax law, and is neither endorsed by nor sponsored by an employer. Rather, it is an individual account arrangement between the Account Holder and the Custodian. As a result, the HSA is not part of an employer’s ERISA benefit plan, even if the employer contributes to it or the employee makes pre-tax contributions to the HSA under an employer’s cafeteria plan. This Agreement is mutually acknowledged and agreed upon by the Custodian and the Account Holder (known collectively as the “Parties”).

For instance, an investment allocation of 5% to balanced funds and 95% to money market funds would most likely not be considered optimal for a typical 25-year-old investor who has 30-40 years until retire-
ment, a significant opportunity to make additional contributions toward retirement, and a good bit of time
to reverse losses as market cycles change. Similarly, an investment mix of 95% in international stock funds
and 5% in money market funds most likely would not be appropriate for a typical 70-year-old investor, who
no longer is working and for whom losses might never be reversed because of the length of market cycles.
These are just commentary on the average: A very risk-averse 25-year-old, with no other savings, poor health and many dependents might well take another view. So, too, a 70-year-old with significant wealth and no dependents might choose to manage his assets far more aggressively than established retirement planning principles might predict.
You may want to consider the “Age Rule of Thumb” as a starting point for your thinking about an appro- priate asset allocation. The “Age Rule of Thumb” provides this basic guideline: Use your age as a potential limit of your investment in fixed-income vehicles such as money market funds and bonds. In other words, if you’re 40, it would result in no more than 40% of your money in fixed-income investments (assuming that
you also have a cash reserve equal to at least three months’ normal monthly expenses). The balance might be
in stock mutual funds. Obviously, this is just a starting point. What makes sense for one investor might be
all wrong for another.

Issues the ALJ Will Consider in Your Case
The hearing will address the application of Medicare laws and regulations to your appeal. The more specific issue(s) to be addressed will include:
(a) ...The specific issue is whether the MA is financially responsible for the services at issue in accordance with §1852(d) of the Social Security Act.
Any part of the decision you are appealing may be reviewed, including parts you agree with as well as timeliness of the ALJ request and the amount in controversy.. If you wish to object to these issues, please indicate and explain your objections under Item 3 in the enclosed Response to the Notice of Hearing. Alternatively, you may submit your written objections at a later time, but no later than five (5) days before the date of your scheduled hearing. You must send a copy of your objections to all the parties to the appeal. The ALJ will make a decision on your objections either in writing or at the hearing.
Right to Representation
You have a right to be represented during the hearing by an attorney or other person. If you or your representative have not completed and submitted an Appointment of Representative form, please contact this office for further instructions and to obtain a form.

Because kindergarten can be a big adjustment for many students and families, we will be focusing on basic classroom routines for the next few weeks so the students have an opportunity to adjust. We will also be focusing on name activities so the students can familiarize themselves with their names.
Homework Folders - A homework folder will be provided to the children that need to be returned the following day. We will not be assigning homework during the first few weeks of school. However, I will be sending the folders home with school newsletters and information about our class.
Investigations - Investigations is the math program we will be using this year. It is a very good program that is hands-on and developmentally appropriate for young students.
Fun-dations – Fun-dations is the phonics program being taught to all kindergarten students. This program is designed to help with alphabet and letter sound recognition.
Snack - Every month I will send home a snack schedule. Everyone should have received the August snack schedule during student visits. If you did not receive a schedule, please let me know. Remember to please bring enough snacks for all students. We currently have 16 students in our class. Please try to select snacks that are low in sugar.
