Prestatorul poate transmite Achizitorului factura pentru plata in avans numai dupa expirarea unei perioade de cel putin 30 de zile de la data intrarii in vigoare a prezentului
Contract, in conformitate cu respectarea prevederilor art. 5 „Intrarea in vigoare si incetarea Contractului”. Avansul acordat de catre Achizitor va fi compensat prin retineri
succesive din sumele datorate de catre Achizitor Prestatorului pentru indeplinirea Serviciilor, pana la concurenta intregii valori a avansului, intr-o perioada de cel mult 24 de luni de la inceperea Serviciilor. Valoarea scrisorii de garantie bancara va fi redusa trimestrial, corespunzator avansului compensat pana la acea data. In acest sens,
Prestatorul va notifica Achizitorul asupra sumei cu care urmeaza a se reduce garantia bancara. Pe baza notificarii primite, Achizitorul va transmite bancii emitente instructiunea de reducere a valorii garantiei. | Translation - Spanish
El Contratista puede enviar la factura para el pago anticipado al Contratante sólo después de un período de al menos 30 días a partir de la fecha de vigencia del presente Contrato, de conformidad con el cumplimiento del Art. 5 "Entrada en vigor y terminación del Contrato. El anticipo concedido por el Contratante se verá compensado por los sucesivos retrasos de las cantidades adeudadas por el Contratante al Contratista para el cumplimiento de los Servicios, hasta el importe total del anticipo, en un período no superior a 24 meses desde el inicio del trabajo. El valor del giro bancario se reducirá trimestralmente, conforme al avance de la compensación hasta esa fecha. En este sentido, el Contratista notificará al Contratante el importe por el que el giro se reducirá. En base a la notificación recibida, el Contratante deberá enviar instrucciones al banco emisor para reducir la cantidad de la garantía. |
