Der Ruf nach einem Arbeitnehmerdatenschutzgesetz wird lauter
Nach den gegen die eigenen Arbeitnehmer gerichteten Überwachungsmaßnahmen bei Lidl, der Deutschen Bahn und der Deutschen Telekom werden die Rufe nach einem Arbeitnehmerdatenschutzgesetz bei Datenschützern und Politik lauter.
Die Überwachung von Arbeitnehmern per Videokamera oder eine Rasterüberprüfung sind sicherlich Extremfälle des Arbeitnehmerdatenschutzes, diese sind allerdings auch schon nach bisherigem Recht unzulässig und teilweise sogar strafbar. Es gibt jedoch eine Reihe von weiteren Fragen, wie innerhalb eines Unternehmens oder Unternehmensverbundes mit Mitarbeiterdaten umgegangen werden darf. Dies umfasst beispielsweise die Weitergabe von Mitarbeiterdaten innerhalb eines Unternehmensverbundes, die Nutzung von Gesundheitsdaten der Mitarbeiter oder die Datenverarbeitung durch den Betriebsrat. Ein weiterer wichtiger Aspekt ist die noch immer hoch umstrittene Nutzung von Internet und eMail am Arbeitsplatz sowie deren Überwachung und Kontrolle durch den Arbeitgeber.
Politisch besteht inzwischen ein breiter Konsens über die Notwendigkeit eines Gesetzes, zuletzt forderte die FDP-Bundestagsfraktion dessen Einführung. Arbeitnehmerverbände wie der DGB und Datenschützer wie beispielsweise der Bundesbeauftragte und die GDD unterstützen diese Forderungen bereits seit längerem. Bisher existieren jedoch noch keine Gesetzesentwürfe von staatlicher Seite.
Für Unternehmen bietet die Einführung eines Arbeitnehmerdatenschutzgesetzes Vor- und Nachteile. Es besteht die Gefahr, dass bisher geübte Praktiken bspw. der Weitergabe von Mitarbeiterdaten in einem Unternehmensverbund in Zukunft verboten wären und für Unternehmen dadurch gravierende Nachteile in der unternehmensinternen Kommunikation und Arbeit entstehen. Andererseits wird die bisher grassierende Rechtsunsicherheit bezüglich der Zulässigkeit vieler im Arbeitsverhältnis genutzter Datenverarbeitungen durch ein Arbeitnehmerdatenschutzgesetz beseitigt. Unternehmen hätten in Zukunft klare Vorstellungen, in welchem Maße sie Daten ihrer Mitarbeiter verarbeiten und nutzen können. Dies würde bspw. auch im Bereich der Kontrolle von Internet und eMail dem Arbeitnehmer verlässliche Regelungen an die Hand geben, statt ihn wie bisher bei Fehlverhalten eines Arbeitnehmers mit möglicherweise unverwertbaren Beweismitteln auszustatten, die im Extremfall sogar eine Strafanzeige gegen den Arbeitgeber veranlassen könnten. | Translation - English
In the wake of the surveillance measures that the Lidl supermarket chain, the German Railroad (Deutsche Bahn) and Deutsche Telekom directed against their own employees, cries for an employee privacy protection law by privacy advocates and politicians are becoming louder.
The monitoring of employees via video camera or profile scanning are certainly extreme cases of employee privacy protection, and are indeed, according to existing laws, illegal and even to some extent punishable. However, there is an array of further questions about how to deal with employees' personal data within a company or a group of companies. This includes, for example, the relaying of employee details within a group of companies, the use of employee health details or data processing by the works council. Another important aspect is the still highly controversial use of the Internet and e-mail at the workplace as well as its monitoring and control by the employer.
By now there exists, politically, a broad consensus on the need for a law, whose implementation has been demanded most recently by the Free Democratic Party's (FDP) parliamentary group. Employee associations like the Confederation of German Trade Unions (DGB) and privacy advocates like, for example, the German Association for Data Protection and Data Security (GDD) have been in support of these demands for quite some time now. However, no government draft bill exists as yet.
For companies, the introduction of an employee privacy protection law presents both advantages and disadvantages. There is the risk that practices exercised until now, for instance the relaying of employee details within a group of companies, would be prohibited in the future, which might result in serious disadvantages for the companies' internal communications and activities. Then again, an employee privacy protection law will eliminate the current rampant legal uncertainty concerning the permissibility of much of the handling of data within the conditions of employment. In the future, companies would have clear ideas as to the extent to which they could use and process employee data. This would, for instance, also provide the employee with reliable rules within the area of Internet and e-mail monitoring, instead of as before providing potentially unusable evidence in cases of employee misconduct that could, in extreme cases, even result in criminal charges being brought against the employer. |
