Résumé : L’essor des techniques d’imagerie fonctionnelle auquel nous assistons depuis une quinzaine d’années a profondément modifié la manière d’aborder la cartographie fonctionnelle du cerveau humain. Il a conduit à l’émergence de vastes projets confrontés à la manipulation d’énormes quantités de données anatomo-fonctionnelles. Ces projets impliquent la possibilité de comparer des individus et de thésauriser les résultats obtenus en matière de localisation anatomique par rapport à un référentiel. Dans cet article, nous décrivons les différentes démarches proposées à ce jour pour répondre à ces besoins et leurs évolutions prévisibles.

Abstract: Lo sviluppo delle tecniche di imaging funzionale, cui stiamo assistendo da una quindicina d’anni, ha cambiato profondamente il modo di guardare alla mappatura funzionale del cervello umano, portando all’emergere di progetti ad ampio respiro che trattano enormi quantità di dati anatomo-funzionali. Questi progetti implicano la possibilità di confrontare vari soggetti ed elaborare un tesauro dei risultati ottenuti in materia di localizzazione anatomica rispetto a un sistema di riferimento. Nel corso del presente studio descriveremo le diverse procedure proposte finora per rispondere a tali esigenze e le loro possibili evoluzioni.

The 1994 Agreement establishing the World Trade Organization (WTO)
establishes rights and obligations for states and other “Members” (such as the EC) to
liberalize market access barriers and market distortions “with a view to raising standards
of living, ensuring full employment, and a large and steadily growing volume of real
income and effective demand, and expanding the production of and trade in goods and
services, while allowing for the optimal use of the world’s resources in accordance with
the objective of sustainable development” (Preamble of the WTO Agreement). As
goods and services are produced and consumed by individuals, WTO dispute
settlement panels have emphasized that “one of the primary objects of the GATT/
WTO … is to produce certain market conditions which would allow … individual
activity to flourish” by protecting the international division of labour against
discriminatory trade restrictions and other distortions. Yet, the same dispute
settlement panel also emphasized that “neither the GATT nor the WTO has so far
been interpreted by GATT/WTO institutions as a legal order producing direct effect”,
i.e. creating rights and obligations not only for WTO Members but also direct
individual rights for traders, producers and consumers. In accordance with these
intergovernmental structures and functionally limited economic objectives of the
General Agreement on Tariffs and Trade (GATT) and the WTO, the words “human
rights” are nowhere mentioned in the text of the GATT 1947 and in the WTO

L’accordo istitutivo dell’Organizzazione mondiale del commercio (OMC) del 1994 stabilisce per gli stati e gli altri “membri” (come la CE) diritti e obblighi volti all’abbattimento delle barriere di accesso al mercato e delle distorsioni di mercato, “col proposito di innalzare il tenore di vita, di garantire la piena occupazione e un volume sostanziale e in continua crescita di reddito reale e di domanda effettiva, ed espandere la produzione e il commercio di beni e servizi, consentendo al tempo stesso un impiego ottimale delle risorse mondiali, conformemente all’obiettivo di uno sviluppo sostenibile” (Preambolo dell’Accordo istitutivo OMC). Considerato che beni e servizi sono prodotti e consumati da individui, gli organi di risoluzione delle controversie operanti in seno all’OMC hanno messo in evidenza come “uno dei principali obiettivi del GATT/OMC … consiste nel creare delle condizioni di mercato che permettano … una crescita dell’attività individuale” attraverso la tutela della divisione internazionale del lavoro contro le restrizioni discriminatorie degli scambi e altre distorsioni. Ciononostante, lo stesso organo di risoluzione delle controversie ha anche rilevato come “le istituzioni GATT e OMC non hanno inteso finora né il GATT né l’OMC come un ordinamento giuridico con effetto diretto”, ad esempio nella creazione non solo di diritti e obblighi per i membri OMC, ma anche di diritti specificatamente individuali per commercianti, produttori e consumatori.
