Source text - German 3. Der Mietzins passt sich jährlich den veröffentlichten bulgarischen Inflationsraten an, erstmals zum 01.01.2007. Im Falle einer Erhöhung hat der Vermieter, im Falle einer Ermäßigung hat der Mieter die Änderung unter Vorlage einer Berechnung mitzuteilen. Eine nicht oder nicht rechtzeitige Mitteilung bedeutet keinen Verzicht auf die Anpassung. Ein erhöhter Mietbetrag ist rückwirkend zu zahlen; im Falle einer Ermäßigung ist der Differenzbetrag rückwirkend zu erstatten.
4. Bei Gesetzesänderungen, die eine Auswirkung auf die Erhöhung der Betriebskosten haben könnten (z.B. Steuersätze etc.), teilt der Vermieter dem Mieter die Änderung rechtzeitig mit. Die erhöhten Nebenkosten werden von dem Mieter übernommen.
5. Der Mieter zahlt eine Kaution in Höhe von 2 Monatsmieten bis zum 1. Januar 2006. Die Kaution
ist auf einem gesondert geführten Konto des Vermieters aufzubewahren. Die Zinsen werden nicht ausgezahlt, sondern erhöhen den Kautionsbetrag.
Translation - English 3. The rent shall be adjusted annually in accordance with the published Bulgarian inflation rate starting January 1, 2007. In the event of an increase, Lessor, and in the event of a reduction, Lessee shall inform of the change by submitting a calculation of the new amount. Failure to inform the other in a timely manner or at all shall not constitute a waiver of the adjustment. An increased amount of rent shall be paid retroactively. In the event of a reduction, the difference shall be reimbursed retroactively.
4. In the event of changes in the law which might serve to increase operating costs (e.g., tax rates), Lessor shall give Lessee due notice of the change. The increased incidental expenses shall be assumed by Lessee.
5. Lessee shall pay a security deposit in the amount of twice the monthly rent by January 1, 2006. The security deposit shall be kept in a separately maintained account of Lessor. The interest thereon shall not be paid out but instead increase the amount of the security deposit.
