I recently took part in a procurement bidding procedure, which according to the Angebot letter was a 'frehaendige Vergabeverfahren'. The whole procedure seemed very non-transparent, and for this reason, I would like to know if others have had the same experience.
For reasons of sworn confidientatliy it goes without saying that I can't mention specific details.
Here the sequence of events:
-I received an Angebot letter from the contracting public institution asking me to state a unit price based on the provided files, to give a firm commitment as to the time I would need to finish the job, and to select the mode of payment. No other information was provided, and the rest of the letter dealt with confidentiality issues etc. There was no mention in the letter of the VOL/A procedure.
-I followed the instructions by quoting a line price and committing to a deadline for completion etc., and submitted the bid before the stated deadline.
-Now, I have received a one-line email curtly stating that, according to a paragraph in VOL/A, my bid was not the most 'economical', and that I now have no recourse against this decision.
There is every possibility that I was indeed not the lowest bidder, but there is absolutely no way of understanding how this decision was made, and according to which criteria. I found it odd that the overall quantity of work was not defined in lines or words in the original letter to me, nor was a flat-rate price requested - is this normal procedure? I can hardly believe that the decision was made based on the simple unit price alone, in that the quantity of work was predefined and would not change.
I would appreciate hearing from others about similar experiences.
