Income tax Jan 23, 2010

That is correct. There's generally no general sales tax on labor. So in most states of the United States, this is not an issue. An exception is the State of California, where you're supposed to charge a sales tax on certain types of labor. But like Yueyin said, even if sales tax is to be charged, you are just collecting it for the state and local government ...

New York State Sales Tax Jan 24, 2010

http://www.tax.state.ny.us/pdf/publications/sales/pub750_208.pdf

A Guide to Sales Tax in New York State

Publication 750 is a guide to New York State and local sales and use taxes.

If your business makes sales of tangible personal property, performs any taxable services, receives amusement charges or operates a hotel or motel, your business must register as a sales tax vendor and obtain a Certificate of Authority. This publication will assist you in deciding whether or not you are required to register as a vendor.

For example, if you are a farmer, contractor, or manufacturer, this publication will help you determine whether you must apply to register as a vendor with the Tax Department. As used in this publication and for purposes of the Tax Department’s registration rules, the term vendor includes persons required to collect sales tax on sales and transactions described in Part II, Making Sales. Also, when used in this publication, the terms sales, purchases, taxable sales, and taxable purchases, include, but are not limited to, where appropriate, rentals of hotel rooms, admissions to places of amusement and dues paid to social or athletic clubs.

Once you are registered as a vendor, you are responsible for collecting and remitting both state and local sales taxes to the Tax Department, along with any use tax you may owe. If your business is an entity such as a corporation or a partnership, the responsibility for collecting and remitting sales tax extends to the responsible persons of the business. Therefore, certain owners, officers, directors, employees, partners or members (responsible persons) of a business that has an outstanding sales tax liability can be held personally liable for the tax due owed by the business.

This publication includes information about local sales and use taxes, as well as New York State sales and use taxes. In addition, this publication provides information on filing requirements and the record keeping responsibilities for sales tax vendors. It is important that you thoroughly read all the information contained in this publication so that you are aware of the many benefits as well as your duties and responsibilities as a registered vendor to collect sales tax for New York State.

Although this publication explains many areas of sales and use taxes, every situation that could occur is not covered. The Department publishes many industry-specific sales tax publications that provide additional detailed information for these industries. You can obtain copies of these publications and any publication, memoranda (TSB-Ms) or document referenced in this publication by visiting the Department Web site at www.nystax.gov or by calling 1 800 462-8100. If you have any questions about sales and use tax, please contact us by using the information provided in the Need Help? section on the back cover of this publication.

The following products and services are subject to sales tax when delivered in New York State, unless specifically exempted or excluded. This list is intended to provide general guidelines of the types of sales that are subject to tax and is not an all-inclusive list. If your business will be making sales of any of these types of products or services, you are required to register for sales tax purposes and obtain a valid Certificate of Authority prior to doing business in New York State. For further information regarding products and services subject to sales tax, see Publication 850, New York State and Local Sales and Use Tax Quick Reference Guide, which is included as Appendix 2 in this publication

Items and services subject to tax

Generally, the sales tax is imposed on:

• retail sales of tangible personal property; unless specifically exempted in the law;

• sales of certain services (see page 19);

...

Anyway, it's a whole other ball of wax in some states if you are required to register as a vendor.

Jan 24, 2010

Zhoudan wrote:
