客户非质量问题因故拒收译稿,翻译公司不支付翻译费如何处理?

这事本不想说,但想来想去总不对劲。发出来请各位前辈同仁谈谈高见吧!

今年6月底,北京一家翻译公司(总部在英国)发来一份急件:当天中午1点多钟发稿件,下午她们下班前

就要回译稿。因双方已合作了半年,此前沟通和付款方面都还是不错的。于是,当时立即接下,从外面赶

回做稿件。实际翻译时间近4小时(3000多中文字)。

当天下午按时回复之后,这家翻译公司也没有对稿件提出任何异议(如有,她们通常会立即反馈)。一个

月后,结算了其它款项,但这笔费用没有结算。被告知,客户还没有结算。再过一个月,即八月结算时,

再次没有音信。当问及其中一个她们的同事时,被告知此项目在公司在线管理工具Localizor上不知何时已被取消!

最后,问到公司的项目经理。得到了下面的回邮:

Hi James,

I am writing you this email to discuss the PO for project 10031 in June. Because our client

canceld this project and didn’t need us to deliver it. So I also didn’t ask you for the

files as well.

So I hope you can understand that we cannot pay you for this job this time.

一阵无语后,回头想,庆幸的是,这只是3000多字,几百块钱。如果是30,000字多,或更多..又该如何?

这是这家公司内部操作的问题。如果你们有PO,并且清楚地写明付款条款,而你也是按合约规定按时交稿,翻译公司就应该付款。你的付款跟客户给不给他们付款没关系。他们内部操作的失误所造成的经济损失不能由你来承担。你说的情况,很显然是公司内部PM还没有接到终端客户的确认就下单。当然,也有外方耍赖不付他们钱的时候,不过我还是觉得可能是北京的这家公司觉得是急件,没等他们的客户给确认就先把货派出去了。

非常感谢Tinging! 事实上,在交稿一个月后,即7月30日,对方回邮如下:

Dear james,

Sorry for replying late.

Due to the project 10031 is ongoing now. So we didn’t pay this money to you. We will pay when it's complete. Any problem please let me know.

所以,当时一直比较放心。因为此前她们没有出现这样的情况。

从来没有与国内的公司合作过,他们的付款条款有点怪,难道你的PO里面也是同样的付款条款吗?You get paid when the whole project is complete?

这种公司根本不懂诚信。不值得合作。

PO中对方列出的付款条件(全文)是这样:

TERMS OF PAYMENT

This PO is payable within 30 days upon completion and delivery of work to R****** Network. Please note: Penalties will apply for any rework caused by bad quality of translation or for any rework caused by ignoring instructions and guidelines.

不知这样算不算她们的理由?

我对国内情况比较清楚,“因客户不付款所以不付款”的拒付理由在国内也超出了业者的底线,属于标准的“黑公司”行为。因这种原因拒付而被翻译在网上告状的,很容易就上黑榜了。

翻译公司应该付费 Sep 14, 2007

发出PO又交了稿,也没有提出质量问题,就应该付费。至于最终客户没有付费给翻译公司,那时翻译公司和最终客户之间的问题。

PO里根本没提什么ongoing project,而且如果是ongoing project的话,通常不需要急件处理。你一个月后收到的那封信是明显的托时间,这样他们可以有更多的时间跟他们的客户要钱,估计是在他们看清楚实在是付款无望的情况下,又被你追问,才给你写了那封信。

一阵无语后,回头想,庆幸的是,这只是3000多字,几百块钱。如果是30,000字多,或更多..又该如何?

请各位前辈同仁指教指教。James在此多多谢过!


翻译公司有时也需要沟通,其实主要需要教育的是一些不懂行规的小卒子:
1)和这个Sabrina沟通,告诉她这种情况你没有错,她们应该付款给你,客户和他们的关系,和他们和你的关系无关,可以客客气气地多沟通几次;
2)如果沟通无效,用通样的话直接和她的顶头上司沟通;直到有明确结果(final decision);
3)如果结果是他们付给你,一切OK,如果不付,以后就不用再合作了。

按照你所说的情况,他们无任何理由不付你钱。如果经再三联系仍解决不了问题,则可威胁将该翻译社登上Blue board或其它翻译网站的黑名单,例如:
http://www.translationdirectory.com/non-payers.htm

根据我的经验,这种威胁将会起一定作用。
