Hi,

Can anyone out there tell me what the English legal ref. is we need to put on invoices now in implementation of the new EU VAT Directive pls?

Dear Helen,
The German Chamber of Industry and Commerce (IHK) recommends the above statement (as well as other variants)

Regarding your actual question:
I put the German law on my invoices, because this is the legal basis of my invoice.
The British law isn't applicable because your place of business is Italy (the service is considered rendered at the place of business of the client only for VAT purposes, Italian law continues to apply in all other respects).

However, I am not a lawyer and do not have a lawyer. Does this sound reasonable and can someone back it up with a solid reference?

P.S.: If it is simply a courtesy to your customers, a clear description of the facts might be more helpful: You pay no VAT and your clients are responsible for reporting and paying VAT in their own country.

Thanks for your contributions so far, I should just clarify:

1) Despite my proz address, my business is actually based in England and I therefore issue English invoices.

2) I am aware I do not need to charge VAT, but have been asked to state the reference to the English law that implements the EU Directive... this is what I really need to know...

The Value Added Tax (Amendment) (No. 5) Regulations 2009 No. 3241

I don't think we call these (or regard them as) "Laws" as they do in Italy.

I'm not because I'll never reach the high limit of £70,000. If you are not, all they need to know is your tax number.

I invoice through an English company, so yes - am VAT registered....

If you going to be "a farmer" and plough even deeper, go th HMRC website and search for "reverse charges".
