What do I do about VAT when invoicing a court in france for a translation?

Hi,

I've been contacted by a tribunal correctionnel in France to do a translation. They told me that the fees are 25 euros per page and I have to fill in an état de frais. I asked about VAT (I am registered in france and normally have to charge VAT on all of my invoices) but they said there is no VAT. I have no idea how this works. Do I still have to do an invoice and if so, do I need to add vat on top?

So, you invoice them (calling the invoice "état de frais") without charging VAT. It makes a lot of sense, since you are invoicing the government.

6 L’expert et la TVA

Les rémunérations prévues pour la traduction et l'interprétation s’entendent hors taxes. Les experts assujettis à la TVA ont droit à ajouter le montant de la TVA à leurs mémoires, conformément aux dispositions du décret n° 94-757 du 26 août 1994, publié au J.O. du 02 septembre 1994, relatif aux tarifs des officiers publics et ministériels et des auxiliaires de justice.

L’expert judiciaire exerce une fonction pour la justice, mais il n’est pourtant pas un fonctionnaire et perçoit une faible rémunération. S’il exerce sa profession principale en tant que salarié ou libéral, il est libre d’appliquer ses propres tarifs en matière de traductions certifiées à sa clientèle extra- judiciaire. Que sa source de revenus accessoire soit judiciaire exclusivement ou judiciaire et extra- judiciaire, il doit, dans tous les cas, cotiser à toutes les caisses obligatoires : Urssaf, Caisse de maladie, Caisse de retraite complémentaire (Cipav en l’occurrence), et payer la taxe professionnelle. En fonction de ses revenus, il sera tenu ou non d’appliquer la TVA, mais il pourra choisir d’y être assujetti. Au niveau fiscal, ses revenus provenant du secteur judiciaire viendront s’ajouter à l’assiette imposable.
