Payment issue - delay in correction

Dear colleagues,

I have provided translations amounting to approximately 30.000 words to an Italian translation agency whose customer is a major German company.

The deadlines for this work ranged between end of November and mid December 2007.

It was agreed that "before payment is made, the COMPANY (in this case the Italian Agency), shall first establish whether or not the CONTRACTOR (the translator) has met the obligations arising out of this contract.

Now, I have received an e-mail from the Italian agency stating that the reviewers of the German company are very busy and feedbacks will not be available before mid February...

They state that it is not fair, but that it is out of their control...

In my opinion the problem is between the agency and its customer and should not concern me or the other translators who have provided work punctually.

I would be grateful for any recommendations of how to proceed in this case...

As it stands, if the company chooses not to make its determination until 2090, they have no obligation to pay you until then. Whether that's enforceable is another issue. However, you agreed to it. A lawyer could tell you what your options are.
