(to post) bonds backed by real or personal property Explanation: It would be very useful to know the country of origin of this text. I suspect it may be from Argentina (mayb Peru) and it appears that "contracaución" may be in Argentina what "caución" is in Spain and other countries: "prestación de caución por parte del demandante para responder de los daños y perjuicios que la adopción de medidas cautelares pueda causar al demandado" (i.e., plaintiff’s posting of a bond to cover damages that the adoption of provisional remedies may cause the defendant." If that is the case (and perhaps some Argentine colleagues can confirm), I believe this is simply saying that the power of attorney authorizes the attorney-in-fact to post such bonds, being guaranteed by either personal property (bienes muebles) or real property (bienes inmuebles). I am basing this answer on the following quote from the Argentine Código Procesal Civil, but I was unable to check the code directly: “La contracautela tiene por objeto asegurar al afectado con una medida cautelar, el resarcimiento de los daños y perjuicios que pueda causar su ejecución”, y que “La contracautela puede ser de naturaleza real o personal…”. Article 613 Código Procesal Civil (Argentina) http://www.hechosdelajusticia.org/N007/contracautela.htm (P.S.: All Spanish legislation is available on Internet free at http://noticias.juridicas.com/. Is there a similar site for Argentine, Mexican, etc. legislation??) -------------------------------------------------- Note added at 3 hrs 12 mins (2006-01-18 09:16:02 GMT) -------------------------------------------------- Although Smartrans' options are certainly valid, they are specific types of bonds that can be posted with respect to civil proceedings, while the text to be translated is quite generic. For many other types of judicial bonds that can be posted in civil proceedings, see Black's Law Dictionary, 8th ed. |
