Fictieve arbeidsovereenkomst

ik denk dat het pas zin heeft de 'semantische' weg te bewandelen als de 'juridische weg' is uitbewandeld, d.w.z. als duidelijk is geworden dat er geen Anglo-Saksische juridisch equivalente term bestaat.
Dat laatste lijkt me een beetje onwaarschijnlijk want ik denk dat de belastingdienst daar ook wel te maken zal hebben met dat schemergebied tussen formeel en niet-formeel.

Wat die sematische weg betreft, heb ik ook dingen bedacht als 'not legally formalised, non-formalised', maar ik weet niet of dat fris Engels is.

In ieder geval denk ik dat eerst de juridische invalshoek uitputtend moet worden onderzocht, als je het echt goed wilt doen.

De beste omschrijving van 'fictieve arbeidsovereenkomst' lijkt me 'niet-arbeidsrechterlijke arbeidsovereenkomst'. Of niet?

is dat het ook gebruikt wordt als aanduiding voor iets dat 'false' is, vals of object van fraude. 'Fictitious goods/sales', bijvoorbeeld. 'Legal ficion' bestaat als iets dat niet echt is, maar dat wordt aangenomen om het proces te vergemakkelijken of zelfs mogelijk te maken. Zoals bijvoorbeeld het concept van een rechtspersoon: als het een bedrijf is, worden daarop dezelfde rechten en plichten van een natuurlijk persoon geprojecteerd alhoewel het geen natuurlijk persoon is. Het probleem met het woord 'fictitious' in deze context is dat de lezer de totaal verkeerde indruk kan krijgen. Daarom moet je daar ofwel een ander woord mee combineren, ofwel voor het woord zelf een ander woord kiezen, zoals de vrager hier gedaan heeft. Ik denk dat het 'Quasi contract' of 'implied-in-fact contract' nog de beste optie is om zeker deze soort van misinterpretaties te voorkomen. Op het eerste zicht, dan wel.

volgens mij is 'fictitious' alleen nog te verdedigen als 'fictitious' in het Anglo-Saksisch recht dezelfde betekenis heeft en op dezelfde manier wordt gebruikt als 'fictief' in het Nederlands recht, niet op grond van de algemene woordenboekbetekenis.

Of dat zo is, wou ik maar overlaten aan de juristen onder ons.

je zou kunnen stellen:

als door de belasting is vastgesteld dat er sprake is van een 'fictieve arbeidsovereenkomst', dan is er sprake van een feitelijke (!) arbeidsovereenkomst die niet juridisch geformaliseerd is

zo gek kan het worden :-)

fictief = niet-arbeidsrechterlijk - een niet-arbeidsrechterlijke arbeidsovereenkomst, wel een arbeidsovereenkomst maar geen arbeidsrechterlijke

een 'echte' overeenkomst is een 'arbeidsrechterlijke overeenkomst, in hun optiek
een 'niet-echte' overeenkomst is een 'niet-arbeidsrechterlijke overeenkomst', in hun optiek

'fictief' has specific, unusual meanings:

..... fictief erfrechtelijke verkrijgingen. Laatstgenoemde situatie doet zich voor als aan bepaalde voorwaarden is voldaan.

hier betekent 'fictief' zoiets als 'formeel volgens de wet niet maar onder bepaalde voorwaarden toch wel' (net zoals hier lijkt het: formeel volgens de wet geen arbeidsovereenkomst maar onder bepaalde voorwaarden toch wel)

fictief opzegtermijn
fictief betekent hier zoiets als: arbitraire opzegtermijn ingesteld voor bij acuut ontslag (gelijk aan de normale opzegtermijn) waarbij formeel van opzegging geen sprake kan zijn
je kunt niet zeggen dat 'fictief' hier in de normale betekenis wordt gebruikt - die opzegtermijn bestaat wel degelijk

fictieve arbeidsverleden
Uw fictieve arbeidsverleden bestaat uit alle jaren vanaf het kalenderjaar waarin u 18 jaar werd tot en met 1997.

Als je al die jaren gedurende een bepaalde tijd hebt gewerkt dan is het fictieve arbeidsverleden gelijk aan het feitelijke arbeidsverleden ... Hoe los je dat nu weer op? :-)

In case 'fictitious' would be an option here, then, so it would seem to me, you will have to use the terms agreement/contract as well, because this is what 'fictitious'/'fictief' refers to.

I mean, the 'relationship' between the trainee and the 'employer' as not 'fictitious' at all, they are factually working with them'
It not a fictitious relationship, but a fictitious (if this word would apply) employment agreement/contract

Well, you could argue that by using the words 'employer-employee', rather than 'trainee' and 'the organisation they work with' you solved this problem. :-)

I consider that what they mean is what I said. The problem with 'fictitious' is that it may refer to something that is imaginary and thus does not apply. 'Fictief' is less thouroughly defined than 'fictitious'.
I would definitely add something in the first part if I was to use 'fictitious'.

Wandering off into other terminology could lead to a case of sudden-death. Don't mess around when it's legal. Of course it's only my opinion but I have been earning my living translating legal docs for quite a few years ......

is not to the point here. Just put down something that is comprehensible to normal English people and then it should be comprehensible to others as well. The EU has many issues, one of which is that they think they know it better than any other (take that from an insider).
I think you should definitely retain some sort of 'contract' or agreement. The thing they mean is that there is no formal employee-employer contract that was signed, so none that the labour court can refer to in case of disputes, but that there is a question of a kind of unwritten one (hence fictitious) as the intern is receiving some sort payment for his work. In that, some general principles will probably apply as they are set in the labour laws of the country this applies to, even if the employer claims there is no contract so he may do what he pleases.
I don't know if you should use 'fictitious'. Although it can mean 'accepted or assumed for the sake of convention', it also has connotations with imagination and such (as you know). In your place I think I would opt for 'unwritten' in combination with 'no formal' in the first part or for 'officious'.

EU English is ruining/making a mockery of our language. In some aspects it even worse than Dunglish because the input comes from all sorts of non-native English EU employees. (English isn't the only language that is suffering from this). In any case, please aim for real English.
