non-excessiveness criterion Explanation: The reference they quote doesn't seem to make sense, because article 295 doesn't have a paragraph 4 (as your reference shows, they're lettered from a to d), and there is no subparagraph 4 (I looked it up). Maybe it's a different version of the act they're referring to. However, I don't see any reason not to use a straight, literal translation.
