German to English translations [PRO]
Law/Patents - Law (general)

fair and equitable adjudication

Explanation:
- namely, finding justice and reaching 'equitable' (small E) and fair vs. partisan outcomes by adjudication.

Example sentence(s):
  • Wir erstellen jährlich über 800.000 Schaden- und unfallanalytische Gutachten und tragen somit zur Rechtsfindung bei. dekra.de We produce more than 800,000 damage and accident analyses a year, and thus help to achieve an equitable conclusion.
  • Giving judgment in Beumer v Vinci [2016] EWHC 2283 (TCC), Fraser J recapped that adjudicators must comply with the requirements of natural justice.

neutral  AllegroTrans: No doubt at all that adjudication should be fair & equitable, but this is over-translation

-> OK. Then just omit the qualifiers of fair and equitable (ex aequo et bono). The web refs, though, suggest that Recht has as much the sense of justice as of the law.

establishing/determining the applicable law

Explanation:
I have yet to find a decent translation of this concept ("finding/extracting the law" doesn't count) but I think my solution will fit the German definition you cited.

agree  Haigo Salow: determining is better than establishing, since the laws have already been established, they just need to be found and interpreted. IMO

-> Thanks. I think I was trying to use "establish" in the sense of "put beyond doubt/prove", based on Merriam Webster
