However, the authors of the Incident Investigation Report have purported to identify on these photographs where xx was on Platform 8 “Pre Accident” and “During Accident”. However, whether this is supposed to be figurative or something of a guess, the arrows identify “The Injured Person”. On the “During Accident” photograph, he is nominally identified as being in an inherently unlikely position. It is unlikely because it is completely contrary to the evidence of the three key eyewitnesses who were very much closer than anyone else; their evidence is that xx was at the Platform 7 end of Platform 8 when the 3-ton hoist failed and that he fell immediately, even trying to grasp the chain from the 3-ton hoist as he fell. If that evidence is right, and I consider that it is, he could simply not have ended up where the “During Accident” detection shows him: this would have involved him climbing up or at least holding on to something on the catwalk, whilst it went through what seems to be 150° with a vertical drop before then whilst it swung through below the 750kg hoist and twisted 180°. He would have been with the falling catwalk moving at some speed, gone through the vertical and not fallen until, as the “During Accident” photograph shows, the catwalk was nearly horizontal at the far side of Platform 8 below the 750kg hoist fixing. If anything, he would have dropped down to the bottom of the falling platform no later than it arrived at the vertical falling position. It is also unlikely because by the time depicted on the “During Accident” the catwalk would have been beginning to swing backwards towards Platform 7, the rope pressure would have eased and there would be no falling weight operating against xx and his rope.
