¿Qué son los salarios de tramitación?

Son las cantidades que el trabajador deja de percibir mientras se tramita un procedimiento judicial contra, por ejemplo, la decisión de extinguir su relación laboral hasta la fecha en la que se dicte le notifique la sentencia judicial en la que se declare la nulidad, la procedencia o improcedencia del despido.


Su importe coincidirá con el de los salarios que hasta la fecha venía percibiendo el trabajador. Por su parte el empresario está obligado a mantenerle en situación de alta en Seguridad Social durante este periodo.
