لأحكام التى حازت حجية الأمر المقضى تكون حجة فيما فصلت فيه من الخصومة ولا يجوز قبول دليل ينقض هذه القرينة ولكن لا تكون لتلك الاحكام هذه الحجية الا فى نزاع قام بين الخصوم أنفسهم دون أن تتغير صفاتهم وتعلق بذات الحق محلا وسببا

2- وتقضى المحكمة بهذه الحجية من تلقاء نفسها
