different condition specification Explanation: different condition specification or different condition: على حالة مختلفة or varying condition: حالة متباينة -------------------------------------------------- Note added at 1 hr (2018-11-18 23:43:40 GMT) -------------------------------------------------- خيار فوات الوصف هو حق الفسخ لتخلف وصف مرغوب فيه اشترطه العاقد في المعقود عليه ومثاله: أن يشتري إنسان شيئاً ويشترط فيه وصفاً مرغوباً له، كمن اشترى حصاناً على أنه عربي أصيل فإذا هو هجين. إن فوات الوصف المرغوب فيه بعد أن حصل الالتزام به من البائع، هو في معنى فوات وصف السلامة في المبيع إذا ظهر فيه عيب، فكما يثبت في الصورة الأخيرة خيار العيب يثبت في الصورة الأولى خيار الوصف. وكل من الخيارين يثبت لتخلف شرط في المحل غير أن الشرط في خيار العيب ثابت دلالة كما يقول الكاساني، أما في خيار الوصف فهو ثابت نصاً. إن فوات الوصف ليس من قبيل العيب لأن العيب يجب أن يخلو الشيء عنه عادة وليس كذلك فوات الوصف ومن حيث الحكم لا يضمن البائع فوات وصف في المبيع ما لم يكن الوصف مشروطاً في العقد أما العيب فإن ضمانه من مقتضى العقد ولا يحتاج إلى شرط. |
