einstweilige Verfügung auf Unterlassung Explanation: die Antwort des Kollegen /der Kollegin war absolut richtig. Ich wollte nur ergänzen: "addition to any other damages, rights, or remedies the Company may have at law or in equity" = zusätzlich zu allen anderem Schadenersatz sowie anderen Rechtsansprüchen und Rechtsmitteln, die dem Unternehmen nach Recht und Billigkeit zustehen. Equity: Billigkeit ist ein besonders stark im amerikanischen Recht verwurzelter Rechtsbegriff, der dort weitaus mehr Bedeutung hat als bei uns. Die gesamte Textpassage kommt übrigens in Verträgen, Statuten etc. sehr häufig vor und lautet immer ähnlich. Es lohnt sich, das als Vorlage anzulegen, wenn man erst einmal eine gut formulierte Übersetzung erarbeitet hat. Viel Glück! Dietl/Lorenz |
