The parties to a "Settlement Agreement and Release" by which all claims of the Settling Plaintiff shall be resolved are named "settling defendant" and "settling plaintiff". I am not sure how to include the settling bit into the German translation?

I think I use in the definition ("der sich vergleichende Kläger/Beklagte" oder "der Beklagte") and then stick with "der Beklagte/Kläger" troughout the rest of the document! Thanks
