nessuno appello è stato presentato per l'ordinanza in virtu' Explanation: non trovo corretto dire 'ricorso in appello', in quanto il ricorso e l'appello sono due tipi diversi della categoria impugnazione. -------------------------------------------------- Note added at 1 day2 hrs (2016-12-10 20:07:54 GMT) -------------------------------------------------- Nel linguaggio comune 'ricorrere' è sinonimo di 'impugnare una sentenza' e si può' dire benissimo. In un atto giuridico pero', occorre stare attenti. Il giudizio di impugnazione può' essere introdotto con atti diversi, ad esempio ricorso, citazione, reclamo, ciascuno dei quali ha requisiti propri ed è soggetto ad un determinato regime. Quando l'appello è introdotto con ricorso, come nel caso della commissione tributaria o nel processo del lavoro, chiaramente si ricorre. Nel caso in cui sia introdotto con citazione, pero', io direi che impugno, che vado/faccio appello o che appello l'ordinanza.
