§ 20-39
Prohibition continues notwithstanding dissolution of previous marriage
In the cases mentioned in § 20-38.1, in which the relationship is founded on a marriage, the prohibition shall continue in force, notwithstanding the dissolution of such marriage by death or divorce, unless the divorce be for a cause which made the marriage originally unlawful or void.


Chodzi mi tutaj o użycie słowa "originally" w końcówce zdania. Chyba że przyczyną takiego rozwodu była niezgodność z prawem lub nieważność tego związku małżeńskiego od samego początku?


Dla jasności, § 20-38.1 dotyczy zakazu zawierania małżeństw między rodzeństwem, wstępnymi i zstępnymi itp. oraz zawierania małżeństw w przypadku, gdy poprzedni związek małżeński jednej ze stron nie został jeszcze rozwiązany.

First you must look at the language in § 20-39 "in which the relationship is founded on a marriage" and ask what relationship there is in § 20-38.1(1). There are only two possible relationships and a marriage before a divorce of a prior marriage is void ab initio so the only actual legal relationship is the "earlier marriage."

Asker: Thank you. I can understand this refers to the prior (earlier) marriage but I just could not find a way to make it sound clear in Polish. Ab initio means "od początku", which was my original thought.
