In practice, the standard of “beyond a reasonable doubt” is most often used to prove this fact, which is contrary to international standards expressed in decisions and directives of the European Parliament, European Council, FATF, and MONEYVAL.

The Republic of Serbia, as a member of the Council of Europe and its MONEYVAL Committee, is obliged to harmonize its laws and practices with the stated standards, including the “preponderance of the evidence” standard of proof in the context of seizure proceedings.
