un poco más de contexto del contrato ayudaría en saber en que persona poner el verbo, pero es una forma antigua del verbo "to witness" - ahora se dice "He witnesses" pero antiguamente (y en este texto legal) se dijo "He witnesseth".

Explanation:
'Witnesseth' es un verbo en tercera persona singular que se refiere a lo que hace el documento en si, es decir, atestiguar el acuerdo, como ya se ha dicho en respuestas anteriores. Por ello, una traduccion literal seria algo asi como 'por la presente se deja constancia de...'. Pero ocurre que en espanol se sigue un formato distinto, aunque venga a significar lo mismo. Se presenta a las partes, y luego estas pasan a EXPONER los motivos del acuerdo en las clausulas expositivas ('Whereas Clauses' o 'Recitals'). En tu lugar, omitiria las muletillas de 'whereas' (pondria 'Las partes EXPONEN: 1. Que tal y cual, 2. Que esto y lo otro, etc.'). Al final de esta parte se suele poner algo del estilo de 'Por todo lo anterior, las partes... ACUERDAN:'
