In many similar copyright or confidentiality contexts, the owner's right is effectively inapplicable IF the information already exists in the 'public domain' --- in other words, is either 'general knowledge' (within a specialist field!), or is at least publicly available in print in some form or other (books, magazine articles, websites etc. etc.)

The term 'literature' (often in fact 'the literature' is commonly used in technical/scineitifc circles to mean 'the totality of written knowledge on a given subject', and NOT just what we think of as 'English literature' or literary material.
