"A redundancy benefit is paid to employees or civil servants who are made redundant. The benefit is also paid when someone leaves on their own accord because you as an employer can not provide sufficient work or pay."

Privredna banka Zagreb posljednja je u nizu kompanija koja je objavila višak zaposlenih koji će se uz isplaćenu otpremninu vrlo brzo naći na ulici i morati odlučiti što dalje sa svojom karijerom.
Iako radnicima u trenutku otkaza čak i najviša otpremnina teško može nadoknaditi gubitak radnog mjesta, činjenica je da dio najuspješnijih kompanija ipak radnicima isplaćuje pristojne iznose otpremnina.

Pravo na otpremninu ima radnik kojem poslodavac otkazuje ugovor o radu nakon 2 godine neprekidnog rada (kod tog poslodavca), osim ako se otkazuje iz razloga uvjetovanih ponašanjem radnika.

Kad postanete višak radne snage imate pravo da vam se plati beneficija na ime otpremnine jednaka ukupnom iznosu na vašem računu.
U Ugovoru o trustu otkaz viška radne snage definira se kao: ‘Prekid ili prestanak radnog odnosa člana iz bilo kojeg razloga’.

Isplata beneficija
Kad poslodavac i/ili član upute administratoru popunjen obrazac zahtjeva i druge relevantne informacije, platit će se beneficija na ime otpremnine direktno članu putem čeka ili elektronskim transferom novca. Administrator će općenito procesuirati isplatu u roku od 3 radna dana od prijema popunjenog obrasca zahtjeva.

Each of the following payments is considered to be a ‘redundancy benefit’:

• a severance payment, or similar payment, made to an employee on cessation of the employee’s employment;
• a payment made to an employee as a result of the shortening of a retention period; and
• an incentive payment to retire.

However, the definition of a redundancy benefit as set out in the Directions specifically excludes any payment made to an employee as redundancy pay under the National Employment Standards (NES), as set out in s.119 of the Fair Work Act 2009.
