Law/Patents - Insurance / Solvabel akkoord met schuldenaars (Solvent scheme of arrangement)

English term or phrase: scheme adjudicator

Definitie: Where mutual agreement cannot be reached between potential creditors of the scheme, they are referred to an adjudicator, who is an actuary and whose decision is binding.

Het gaat hier om een 'solvent scheme of arrangement', m.a.w. de verzekeringsmaatschappij is NIET failliet, maar houdt op te bestaan en betaalt de vorderingen, indien er wederzijdse instemming over is bereikt volledig. Als er geen wederzijdse instemming wordt bereikt wordt de vordering verwezen naar een 'scheme adjudicator'. Voor zover ik weet bestaat dit bepaalde akkoord met schuldenaars niet in Nederland, maar hoe wordt zo iemand binnen het faillissementsrecht bijvoorbeeld genoemd: (gerechtelijk) bemiddelaar/arbiter/mediator?? Alvast hartelijk bedankt voor het meedenken! (Als er iemand ervaring heeft met het vertalen van 'solvent schemes of arrangement' en een aantal links weet, zou ik zeer dankbaar zijn!)
