Sounds like a contradiction in terms but it is not.

A capital gain is any gain made from a capital transaction (the buying and selling of assets. You can be liable for capital gains tax or CGT (un impot sur les plus-values de capitaux) on that gain.

The capital gains rules (le régime des plus values) determine which taxpayers can apply for relief (dégrèvement, allègement fiscal) in which situations and in repsect of which liabilities.

In your extract, this means that although there is a gain in so far as money has been received in consideration of the shares disposed of, taking various factors into account, the global result has been a loss. Example : In 1999 your buy 10 shares @ £5 each (cost £50). In 2000, you sell them again but you sell them @ only £2.50 each. You make a gain in that you receive £25. However, you have made a loss of £25 over the 12-month period. In certain circumstances, certain taxpayers may be liable to apply for tax relief (un dégrèvement fiscal) in respect of that loss. In one sense a taxable gain has been made ; in another, a loss has been suffered too. Logically, you lose out on the sale and you lose a second time if you are taxed upon the receipts therof at that lower price.

I have over-simplified. Taxation is a complicated business and far from being my speciality. The rules are complicated and change very often. However, I think that this must be something along thesse lines.

CAPITIAL GAINS TAX :
A tax charged on gains arising from the disposal of assets. The tax due is a proportion of the "chargeable gain". This is generally the difference between the gain made on the sale of the asset once you have deduct the cost of acquiring it. IF THIS RESULTS IN A LOSS, THIS MAY BE OFFSET AGAINST OTHER CHARGEABLE GAINS IN THE SAME YEAR OR SUBSEQUENT YEARS. (Ce que je voulais dire par mon exemple). The assets acquired which may be concerned are, for example, stocks, shares, unit trust, land... Exclusions include main residence, cars adn private property with an expected life of less than 50 years. (Cette dernière petite partie me plait!).

pour info, des règles similaires s'appliquent dans le cas d'une entreprise et le dégrèveemtn s'appelle alors "roll-over relief".
