pour "materail breach", il me semble que l'on retrouve fréquemment l'expression "violation patente"
La déf. de "patente" est: évidente, manifeste, qui ne prête à aucune contestation.

Bien que j'ai aussi fréquemment vu violation substantielle. (dans le sens d'importante, considérable)
