Dans un avis juridique, l'avocat mentionne "XXX has validy submitted to the jurisdiction of the TRibunal de Commerce of Paris the confirmation of receipt of te order. A judgment delievred by such court of the Chamber of International Commerce of Paris would be recognised and enforced by the courts of Italy by previous statement, with ***** judgment of effect of the award**********, by the Court of Appeal of Bologna.

Asker: Je me suis fiée à ce texte portant sur l'arbitrage en droit italien (http://www.iaj-uim.org/2005/2-Italia.html). Et tel qu'il y est mentionné, les a. 839 et 840 du Code de Procédure civile (et non code civil) portent sur la reconnaissance des sentences aribitrales étrangères devant être obtenues auprès Cour d'appel italienne. Je pense que mon texte souce est erroné en faisant référence au Code civil au lieu du Code de procédure civile (je suis allée lire les articles pertinents du Code civil pour aboutir à cette conclusion!). Et comme l'auteur de l'avis est italien... Merci quand même.
