Par opposition aux moyens imposés ou encadrés, l'idée étant sans doute d'étendre la capacité de résolution des confilts "alternative disputes" au champ le plus large possible en laissant à l'initiative des parties le plus large choix des moyens de preuve ou d'argumentation?
Pour l'instant on utilise apparemment "initiative des parties" pour la saisie d'une juridication (ci-joint référence pour un conciliateur), mais cette terminilogie pourrait sans doute s'étendre au choix des moyens.
