Explanation:
This lien (droit de rétention/privilege) is held by the lender and described as being “unperfected” until certain events occur. If those events do occur, then the lien springs into action and becomes “perfect”.
It is a sort of charge which is conditional upon certain events occurring in order to become operable, as if it were “suspensive”.

Springing Subordinated Lien
…The springing subordinated lien gives Energy Capital, as a lender, security that its loan would be paid off. If there were a default under the first mortgage, the first mortgagee may file a claim with the FHA for payment. (The FHA typically pays approximately 95 to 99 cents on the dollar.) After the first mortgage is assigned to HUD and the FHA Fund reimburses the mortgagee, Energy Capital's loan "springs" into first position and has a priority ahead of the FHA mortgage. If there were a default, Energy Capital had the property as a security interest. It should be noted that Energy Capital's agreement with Fannie Mae required that the AHELP loan contain the springing subordinated lien provision….
