If there had been commercialisation made of the subject mark XXX then our searches would have identified said use within the past five years. However, in order to prove a negative we arranged for an agent in Paris to visit a number of YYY stores and make inquiries direct with staff members employed therein. Again, these inquiries confirmed that no use or ***application*** is made of the mark XXX by YYY. We have been informed that the trade mark XXX is not a brand of the company nor is it used or ****applied*** by YYY.

En considérant "application" dans le sens de 'practical use', on pourrait traduire "no use or application" par "aucun usage" --> ...aucun usage n'est fait de la marque...

b)- applied dans le sens de "to apply for a patent" (déposer une demande de brevet) -> YYY n'a ni utilisé [par le passé], ni DÉPOSÉ UNE DEMANDE DE BREVET pour cette marque...

C'est ce que je comprends. On utilise la marque (on fait des pubs, on la mentionne dans des docs d'affaires, etc) et on l'appose sur une surface ou un produit.
Je ne sais pas comment peut-on rendre cette notion d'une manière plus condensée:-))
