Explanation:
explicit means "ausdrücklich". Auch eine mündliche Vereinbarung ist "explizit", d.h. ausdrücklich, ein "Handschlag" auch. Eine implizite, sprich stillschweigende oder konkludente Vereinbarung kann z.B. dadurch zustande kommen, dass eine Partei nicht widerspricht, also im wahrsten Sinne des Wortes "still schweigt".
"Formell" würde doch aber bedeuten, dass die Vereinbarung zwingend einer gewissen Form bedarf (etwa eiener Beurkundung). Eine ausdrückliche Vereinbarung muss noch lange keine formelle Vereinbarung sein. Auch wenn diese Frage offensichtlich bereits entschieden ist, denke ich, dass dies Übersetzung juristisch nicht korrekt ist.
Die beiden Begriffe, die hier gegenübergestellt werden sind "ausdrücklich" und "konkludente" Vereinbarung oder "ausdrücklicher" und "konkludenter" Vertrag.
