Until the Distribution Date, the Trustees may from time to time add one or more Persons, other than a Contributor, to become Beneficiaries of the Trust subject to such terms and conditions as the Trustees consider appropriate in their absolute discretion, provided that:

any individual who is to be added is an issue of the Settlor and is not a Contributor;

any Person who is to be added and who is not an individual referred to in paragraph (a) above is:

a trust which contains provisions that reiterate, respect and are subject to sections 4.4 and 4.11, and which includes amongst its beneficiaries and is limited to, one or more individuals who fall within the class referred to in paragraph (a) above, corporations which meet the conditions set out in paragraph (ii) below or registered charities as described in paragraph (iii) below;

a corporation all of the issued share capital of which is held directly or indirectly by or for the benefit of xxxxx or any other individual or individuals who fail within the class referred to in paragraph (a) above or{711}any combination thereof, provided that the addition of such corporation as a Beneficiary would not result in the application of subsection 75(2) of the ITA;
