The French Finance Act 2010 acknowledges in Article 238-0 A uncooperative states or territories (ETNC) that are taxed with an unfavourable tax rate.

The list as of 1 January 2014 contains the following states and territories: [...]

Furthermore the withholding tax rate for dividends and interests from such countries has been increased to 75%.

XXX reminds its participants of the fact that if such payments are made via a chain of intermediaries, the last French paying agent in the chain shall be responsible for deducting these taxes. Neither XXX’s French paying agent YYY Bank Plc, nor XXX itself are considered as French paying agents. **As both parties are not responsible to the French tax authorities for deducting withholding tax**, payments made to participants will continue to be taxed at the usual rates, irrespective of whether participants are domiciled in a non-cooperative jurisdiction.


Die markierte Stelle ist mir nicht klar. Ist das so zu verstehen:

agree  Rolf Keller: Nur "Einbehalt" stört mich etwas, denn das kann ja auch ein Geldbetrag sein. Gemeint ist aber das Einbehalten als Aktivität.
