Sorry for the typo in the heading of my earlier posting. The sentence in question relates to a development project:
The negotiation and acceptance of Practical Completion as certified by the architect and the developer and the negotiation of any retention pending outstanding works completion.

Die Abnahme ist nicht gesetzlich festgelegt. Das englische Recht versteht die Abnahme nicht als Pflicht des Bestellers. Der Architekt trifft am Ende der Ausführungsphase und am Ende der Mängelbeseitigungsphase bestimmte Feststellungen. Eine fingierte Abnahme ist dem englischen Recht unbekannt. Teilabnahmen sind möglich. Das Ergebnis der Abnahme wird protokolliert. Zu unterscheiden sind die provisorische und die endgültige Abnahme: Das vorläufige Abnahmeprotokoll (Practical Completion Certificate) erstellt der Architekt, läßt der Zustand des Werkes die Ingebrauchnahme durch den Besteller zu. Der Unternehmer hat die festgestellten Mängel nachzubessern. Sodann wird ein weiteres Protokoll formuliert (Certificate of Making Good Defects). Nach der Garantieperiode wird die endgültige Abnahme protokolliert (Final Certificate). Mit der Abnahme trägt der Besteller die Gefahr für den zufälligen Untergang des Werkes.
